Highway Tolls and Fees in Transit Traffic (Czech Republic, Austria, Italy)

Abstract:

Tato bakalářská práce mapuje právní režimy zpoplatnění užívání dálnic, rychlostních silnic a dalších vybraných komunikací a porovnává jejich konkrétní podobu mezi Českou republikou, Rakouskem a Itálií. Analýza právního stavu této oblasti je založena na využití tuzemské, rakouské a italské právní úpravy a také společné právní úpravy Evropské unie (EU). Práce je rozdělena na dva oddíly. V první části poskytuje obecné informace o zpoplatnění pozemních komunikací a představuje jednotlivé varianty poplatků za užívání silniční sítě jak z hlediska daňových soustav zvolené trojice evropských států tak i vzhledem k předpisům EU. Následuje část zvláštní, kde představuji mýtné a časové poplatky ve studovaných státech podle několika kritérií a dále metodou komparace demonstruji na modelovém příkladu trojice různých motorových vozidel aspekty zpoplatnění veřejných komunikací prostřednictvím časových poplatků a mýtného. Pro každý druh dopravního prostředku je proveden rozbor dopadu časových poplatků a mýtného na plynulost tranzitní dopravy a obchodní výměny a také rozbor možné diskriminace v kontextu legislativy EU.

Abstract:

This bachelor thesis addresses and compares the legal aspects of the highway and road tolls and fees in the Czech Republic, Austria and Italy. The analysis is based on the existing and applicable national legislation of the individual countries as well as on the related common regulations of the European Union. The thesis consists of two parts. The introduction part offers the general reasoning behind the fee collection related to the use of public roads. Subsequently, the fees and tolls are considered taxes and their legal definitions are discussed in all studied countries. The related unifying directions issued by the European Union are also mentioned. A detailed view of the highway tolls and fees is provided by the second part of the thesis. The analysis offers a closer look at several defining features of the tolls and fees, and its findings are demonstrated by a case study. The case study takes three different vehicles to illustrate the meaning of the highway tolls and fees in the Czech Republic, Austria and Italy. For every kind of a vehicle, the special attention is paid to the impact of the tolls and fees on several selected areas including the fluency of the cross-board traffic, the international exchange of goods and the general principles of equality contained within the legislation of the European Union.
