Right to acess information

Abstract:

Diplomová práce se věnuje problematice práva na svobodný přístup k informacím. Všichni žadatelé potřebují informace pro své rozhodování. Proto je důležitá znalost práva v této oblasti. Práce popisuje ústavní zakotvení práva na informace v České republice, právo na informace dané mezinárodními smlouvami, situaci ve vybraných zemích. Zmíněny jsou principy práva na informace. Rozebrána je obecná i zvláštní úprava práva na informace (zákon a prováděcí vyhláška). K jednotlivým ustanovením zákona jsou uvedeny příklady z judikatury. Uváděn je současný stav problematiky. Součástí práce je provedené šetření, jak je zákon o svobodném přístupu k informacím naplňován v praxi jednotlivými povinnými subjekty, a následná analýza provedeného šetření.

Abstract:

The thesis deals with the right to free accessibility of information. All applicants need information in order to be able to make decisions. The knowledge of one´s rights is very important in this context. The thesis offers a description of the constitutional right to obtain information in the Czech Republic, right to obtain information pursuant to international treaties as well as a description of situation in some selected countries. Principals of this right are mentioned. The general and special provisions of the right to obtain information are dealt with (the Act itself and the implementing provisions). The thesis also includes examples from judicature. The current situation of this issue is dealt with. A survey is also included in the thesis with focus on the implementation of the Act on free accessibility of information by the entities subject to the Act, as well as the following analysis of the executed survey.
