Legal Protection of Databases and Open Data

Abstract:

Diplomová práce je věnována tématu „Právní ochrana databází a otevřená data“, konkrétně problematice střetu právní ochrany databází, jako projevu principu exkluzivity, a poskytování informací subjekty veřejného sektoru, jako projevu principu dobré správy. Práce se nejprve obrací k historii vývoje právní ochrany databází a právní úpravy poskytování informace veřejným sektorem a otevřených dat, a to na mezinárodní úrovni, na úrovni Evropské unie a v České republice. Dále jsou zanalyzovány režimy právní ochrany databází – autorskoprávní ochrana a ochrana zvláštním právem pořizovatele databáze, limity právní ochrany databází, a je věnována pozornost analýze poskytování informací veřejným sektorem. Závěrem se práce zaměřuje na identifikaci a analýzu problematických aspektů koexistence právní ochrany databází a otevřených dat.

Abstract:

The diploma thesis is devoted to the topic of “Legal protection of databases and open data”, specifically the issue of the contradiction between the legal protection of databases, as a token of the principle of exclusivity, and the providing information by public sector entities, as a token of the principle of good governance. At the beginning, the thesis turns to the history of the development of legal protection of databases and the legal regulation of the provision of information by the public sector and open data, at the international level, at the level of the European Union and in the Czech Republic. Furthermore, the regimes of legal protection of databases are analysed – i.e. copyright protection and sui generis right, limits of legal protection of databases, and attention is paid to the analysis of the provision of information by the public sector. In conclusion, the thesis focuses on the identification and analysis of problematic aspects of the coexistence of legal protection of databases and open data.
