Conditionality and its working in the context of the EU association agenda - energy issues: case study of Ukraine

Abstract:

Podepsání asociační dohody mezi EU a Ukrajinou je jedním z klíčových aspektů vzájemných vztahů, který dává možnost posunout spolupráci na novou úroveň. Pro Ukrajinu to ale znamená i nové výzvy a potřebu dosáhnout určitého pokroku. Překládaná práce bude sledovat vývoj z hlediska naplňování požadavků EU v konkrétní oblasti liberalizace trhů s energiemi (plyn, elektřina) a souvisejících oblastech ze strany Ukrajiny. Tyto požadavky byly postupně zapracovávány do agendy přípravy asociační dohody od roku 2007/08, dále byly zdůrazněny v rámci asociační agendy po vzniku programu Východního partnerství a závaznými se staly v kontextu vstupu Ukrajiny do Energetického společenství (rok 2010). Obsaženy jsou také v asociační dohodě podepsané mezi EU a Ukrajinou v roce 2014. Práce se soustředí na prvky tzv. pozitivní a negativní kondicionality, jejich uplatňování a fungování v kontextu tzv. sousedské evropeizace, a to na případu rozvoje smluvních vztahů a závazků v rámci vztahů EU-Ukrajina (resp. Energetické společenství-Ukrajina). Konkrétně se zaměřuje na úspěchy a neúspěchy evropeizace a fungování principu kondicionality v případě liberalizace trhů s energiemi na Ukrajině.

Abstract:

The signing of the association agreement between the EU and Ukraine is one of the key aspects of relations, that makes it possible to shift cooperation to a new level. For Ukraine, this means new challenges and the need to achieve some progress. This diploma thesis will monitor developments in terms of fulfilling of the EU requirements in specific areas of liberalization of energy markets (gas and electricity) and related areas by Ukraine. These requirements were gradually incorporated into the agenda of the preparation of the Association Agreement since 2007/08, further were highlighted in the framework of the Association Agenda after the establishment of the program of Eastern Partnership and become mandatory in the context of Ukraine's accession to the Energy Community (2010). Also were included in the association agreement, signed between the EU and Ukraine in 2014. This Thesis will concentrate on the elements of the so-called positive and negative conditionality, its implementation and functioning in the context of the so-called neighborhood europeanization, on the case of the development of contractual relationships and obligations between EU-Ukraine (respectively Energy Community-Ukraine). Specifically, it focuses on the successes and failures of Europeanization and functioning of conditionality in the case of liberalization of energy markets in Ukraine.
