The Issue of a Smoking Ban in Restaurants in the European Union

Abstract:

Tato bakalářská práce se zabývá problematikou legislativních přístupů k zákazu kouření v Evropské unii. Cílem této práce je analyzovat právní podobu zákazů v restauracích v členských zemích Evropské unie v porovnání s aktuální právní úpravou České republiky. První část práce popisuje hlavní pojmy, které slouží k bližšímu pochopení dalšího textu. Dále jsou zde uváděny reálné důsledky kouření. Druhá část je zaměřena na prevalenci kouření v populaci, její strukturu a regulaci spojenou s kouřením v celosvětovém měřítku. Třetí část prezentuje podobu zákonů o kontrole tabáku v Evropské unii a dále je soustředěna na jednotlivé zákony o zákazu kouření v pohostinských zařízeních zemí Evropské unie. Je zde provedena analýza jednotlivých zákonů o zákazu kouření v restauracích a barech v zemích Evropské Unie a v České republice. Čtvrtá část prezentuje výsledky dosažené provedenou analýzou, které ukázaly velké rozdíly v legislativních úpravách zákazů kouření jednotlivých zemí i v úrovni jejich implementace. Tato práce prezentuje vzájemné vztahy mezi analyzovanými ukazateli.

Abstract:

This bachelor’s dissertation is mainly focused on the issue of a smoking ban in restaurants in the European Union. The aim of this thesis is to analyse the legal forms of anti-smoking laws in restaurants in member states of the European union in comparision with the current legislation in the Czech republic. First part of this thesis describes the main concepts and helps in better uderstanding of this text. Furthermore, the effects of smoking are noted. The second part is focused on prevalence of tobacco smoking, it’s structure and anti-tobacco law regulations on a global scale. The third part presents the form of tobacco control law in the European Union and it is focused on each smoking ban in catering establishments in member states of the European Union. In this part there is the main analysis of smoking bans in bars and restaurants in each member state of the European Union in comparision to the Czech Republic. The fourth part presents the main outcomes of the analysis which showed big differences between each legislations and their level of implementation. The analysis presents existing relations between analyzed points.
