House arrest and prohibition of entering to sports, cultural and other social events in comparative perspective

Abstract:

Dizertační práce se zabývá dvěma tresty, o něž byl český systém trestů rozšířen novým trestním zákoníkem s účinností ode dne 1. 1. 2010, a to trestem domácího vězení a trestem zákazu vstupu na sportovní, kulturní a jiné společenské akce. Práce analyzuje příčiny a cíle, s nimiž byly tyto tresty zavedeny, a hledá odpověď na otázku stavu naplnění těchto cílů. Podstatnější část práce se pak zaměřuje na analýzu české hmotněprávní a procesněprávní úpravy trestu domácího vězení a trestu zákazu vstupu a jejich komparaci s úpravami vybraných států na základě zvolených kritérií. Ve vztahu k trestu domácího vězení byly vybrány především úpravy států Florida, Kanada, Anglie a Wales, Švédsko a Hesensko, doplněné o zkušenosti s domácím vězením či elektronickým monitoringem z Bádenska-Württemberska, Německa, Švýcarska, švýcarského kantonu Vaud a Slovenska, zatímco ve vztahu k trestu zákazu vstupu byly vybrány úpravy Anglie a Walesu a Francie, doplněné o nedávnou úpravu sousedního Slovenska.

Abstract:

The dissertation thesis deals with two new punishments – the house arrest and the prohibition of entering to sports, cultural and other social events – which were included in the Czech system of punishments with the new Criminal Code, which took effect in 1. 1. 2010. The thesis analyses the causes and goals which led the legislator to introduction of these new punishments and it seeks the answer to the question of the current status of fulfilment of those goals. The substantial part of the thesis focuses on the analysis of the Czech material and procedural legal regulation of the house arrest and the prohibition of entering to sports, cultural and other social events and their comparison with the selected legal regulations on the basis of chosen criteria. Regarding the house arrest the selected states are Florida, Canada, England and Wales, Sweden and Hessen, accompanied by the experiences with house arrest and/or electronic monitoring from other countries like Baden-Württemberg, Germany, Switzerland, canton Vaud and Slovakia. Regarding the prohibition of entering the selected states are England and Wales and France accompanied by the most recent Slovakia regulation.
