Exclusive Jurisdiction in Relation to Immovable Property under Brussels I Regulation

Abstract:

Tato práce se věnuje výlučné příslušnosti soudů ve vztahu k nemovitostem dle nařízení Brusel I. Práce je rozdělena do čtyř tematických částí. V úvodní části je zhodnoceno postavení nemovitostí v mezinárodním právu soukromém a procesním a vymezení zásady lex rei sitae. Ve druhé části je vysvětlen pojem „výlučná příslušnost“ v mezinárodním právu. Třetí část je zaměřena na revizi nařízení Brusel I a nové nařízení. Těžištěm práce je část čtvrtá, která se zabývá článkem 22 odst. 1, jeho interpretací ve světle judikatury a jeho uplatněním ve vztahu k nečlenským státům.

Abstract:

This thesis deals with exclusive jurisdiction to immovable property according to the Brussels I Regulation. The thesis is divided into four main chapters. In the first part, it deals with immovable property in international private and procedural law and definition of lex rei sitae. In the second part the concept of „exclusive jurisdiction“ in international law is defined. The third part deals with recodification of the Brussels I Regulation. This thesis is based on interpretation of Article 22 (1), its impact on third states and judgments of the European Court of Justice.
