The European Commission's Register of Interests Representatives: Analysis of the Financial Disclosure Effectiveness

Abstract:

Předmětem zkoumání diplomové práce je v obecné rovině princip seberegulace představující mechanismus zajištění transparentnosti reprezentace zájmů při Evropské komisi. V konkrétní rovině práce analyzuje finanční částky investované do lobbování institucí EU zveřejněné zájmovými skupinami v Rejstříku zástupců zájmových skupin (Rejstřík ZZS). Primární cíle práce představují jednak zhodnocení kvality metodologie zápisu, která upravuje výpočet finančních částek, jednak zhodnocení efektivity zveřejněných finančních částek vypočtených na základě této metodologie. Práce ověřuje hypotézu, že efektivita zveřejňovaných finančních údajů v Rejstříku ZZS je závislá na zápisu pravdivých, úplných a relevantních údajů. Efektivita přitom souvisí s mírou transparentnosti v otázkách finančních částek investovaných do lobbování institucí EU a zdrojů těchto částek. Prostředky ověření hypotézy jsou rozbory návodu Komise k registraci do Rejstříku ZZS, finančních údajů od 1063 registrovaných zájmových skupin a dat získaných průzkumem mezi registrovanými zájmovými skupinami. Práce dospěla k závěru, že metodologie zápisu do Rejstříku ZZS je nedostatečná zejména kvůli své obecnosti a nevymahatelnosti. Nedostatečná metodologie spolu s pasivním kontrolním systémem pravdivosti a úplnosti registrovaných údajů, slabou motivací zájmových skupin k registraci do Rejstříku ZZS a prakticky neexistujícím sankčním mechanismem vede k nízké efektivitě finančních částek zveřejňovaných v Rejstříku ZZS. V důsledku je nízká i míra transparentnosti finančních aspektů lobbistické činnosti u institucí EU.

Abstract:

The master thesis examines the principle of self-regulation which represents a mechanism for transparency provisions of ensuring interest representation at the European Commission. In particular, the thesis analyses financial amounts invested in lobbying at EU institutions as published by interest groups in the Register of Interest Representatives (the Register). The primary objectives of the thesis comprise on the one hand the evaluation of quality of the registration methodology with respect to the calculation of financial amounts and on the other hand the evaluation of effectiveness of the registered financial amounts calculated on the basis of such a methodology. The thesis attempts to prove the hypothesis that the effectiveness of the registered financial amounts depends on the registration of true, complete and relevant data. Effectiveness relates to the level of transparency in the area of financial amounts invested in lobbying at EU institutions and the sources of such financing. The means for testing the hypothesis are the examination of the Commission’s guidelines for registration in the Register, financial data from 1063 registered interest groups and data gained by means of an interest groups survey. The thesis comes to the conclusion that the registration methodology is insufficient mainly due to its overly general and unenforceable character. Insufficient methodology coupled with a passive control system of truthfulness and completeness of the registered data and a lack of motivation to register into the Register on the interest groups’ part as well as a non-existent sanction policy all leads to low effectiveness of the registered financial amounts. Consequently, the level of transparency of the financial aspects of lobbying at EU institutions is also low.
