Anotácia:

Tato bakalářská práce se zabývá imunitami a výsadami pracovníků institucí Evropské unie, které jsou od samého počátku vzniku Unie důležitými pojmy pro správné fungování organizace. Práce se zaměřuje na historický vývoj, současný stav a právní úpravu imunit a výsad pracovníků EU, a to včetně jejich specifik v jednotlivých institucích. Zahrnuje také rozbor výsad a imunit europoslanců a obsahuje návrhy na zlepšení současného systému, které zároveň berou v úvahu odpovědi z dotazníkového šetření, a to jak od již zmíněných europoslanců, tak od veřejnosti. Práce je strukturována do pěti hlavních částí, které systematicky prozkoumávají různé aspekty tématu, včetně historie, právního rámce a konkrétních institucí. Diskuze o imunitách a výsadách pracovníků institucí Unie je totiž tradičním tématem práva v rámci mezinárodních organizací. Přesto se mu dosud v odborné literatuře věnovala jen malá pozornost. To může být způsobeno tím, že díky rozsáhlé pravomoci Soudního dvora EU jsou otázky často řešeny na této úrovni. Většina mezinárodních organizací nemá soudní orgán pro individuální žaloby, ale vyvinutý právní systém Evropské unie umožňuje každé fyzické nebo právnické osobě, bez ohledu na státní příslušnost nebo bydliště, podat žalobu proti rozhodnutí, které se jí přímo a individuálně týká. Práce se tak snaží poskytnout komplexní pohled na imunity a výsady pracovníků Evropské unie.

Abstract:

This bachelor thesis deals with the immunities and privileges of the employees of the institutions of the European Union, which have been important concepts for the proper functioning of the organization since its inception. The thesis focuses on the historical development, current state, and legal regulation of the immunities and privileges of EU workers, including their specifics within individual EU institutions. It also includes an analysis of the privileges and immunities of Members of the European Parliament and proposes improvements to the current system, taking into account responses from a questionnaire survey conducted among the mentioned Members of the European Parliament as well as the general public. The thesis is structured into five main parts, systematically exploring various aspects of the topic, including its history, legal framework, and specific institutions. The discussion on the immunities and privileges of workers of Union institutions is a traditional topic of law within international organizations. However, it has received little attention in scholarly literature so far. This may be due to the fact that, thanks to the extensive powers of the Court of Justice of the European Union, issues are often addressed at this level. Unlike most international organizations, which lack a judicial body for individual complaints, the developed legal system of the European Union allows any natural or legal person, regardless of nationality or residence, to bring a lawsuit against a decision that directly and individually concerns them. Thus, the thesis aims to provide a comprehensive view of the immunities and privileges of European Union staff.
