The probation´s supervision and its application in the context of alternative sentences.

Abstract:

V diplomové práci jsem se snažila nastínit problematiku probačního dohledu v trestním právu. Do našeho trestního práva byl zaveden institut probace. Tento institut byl zakotven do našeho právního řádu poměrně nedávno, ačkoliv se nejedná o institut zcela nový. Probace je považována za účinný prostředek, kterým lze trestat pachatele a pod odborným vedením pachatele motivovat, aby vedl řádný život a aby se napravil. Probační dohled je institutem, jehož cílem je kontrolovat a sledovat odsouzeného, poskytovat mu odbornou pomoc s cílem, aby v budoucnu vedl řádný život, čímž je zajištěna ochrana společnosti a snížení možnosti opakování trestné činnosti. Probační dohled je jeden z nejvýznamnějších institutů, který v tradičním pojetí trestů a trestní justice má své místo. Probace a probační dohled jsou plně v souladu s konceptem restorativní justice, na kterém je moderní demokratický právní stát založen. Restorativní justice klade důraz na preventivní roli trestního práva a obnovení narušených sociálních vztahů.

Abstract:

I have provided an overview how probation is used in criminal law. The Institute of Probation has been introduced to our Criminal Law rather recently although it is not a brand-new phenomen. The Probation is regarded an effective means of punishing offenders and suspects under supervision, and whatsmore, it fixes their situation and encourages them to lead an orderly life. On one hand, the Probation supervision is an institute which aims to control and monitor the prisoner, to give him technical assistance focused on maintaining the offender's future life, and on the other, it ensures the socioty the protection and lowers the possibility of re-offending or reccurance of the crime. The Probation supervision is one of the most important institutes incorporated into the traditional Criminal Law. The Probation and Probation Supervision are fully compatible with the concept of Restorative justice which is the very base of the modern Justice in democratic countries. The Restorative justice gives the emphasis on the preventive role of criminal law and allows fixing offender's broken social relationships.
