Municipality property

Abstract:

Diplomová práce pojednává o majetku obce. Orientována byla na vyhodnocení užívání majetku obce z hlediska způsobu užívání majetku obcí. Práce je rozdělena na část teoretickou a aplikační. V teoretické části byla provedena obsahová analýza právních souborů a na jejím základě definován majetek obce. Vymezení majetku je z pohledu zákona o obcích, občanského zákoníku. Zachyceny jsou základní principy vztahující se k majetku, charakterizovány druhy majetku a jeho účetní rozdělení. Objasněny byly aspekty správy majetku obce, zejména pravomoc orgánů obce, péče řádného hospodáře a odpovědnost. Charakterizovány jsou specifiky nabývání, prodeje majetku obce a profil závazků vyplývající z právního jednání. Popsán je specifický proces zajišťující zákonnost nakládání s obecním majetkem. V aplikační části jsou informace z teoretické části implementovány do praxe. Výzkum byl realizován ve třech vybraných obcích Středočeského kraje, obce s rozšířenou působností Kutná Hora, konkrétně v obcích Čestín, Vavřinec a Zbizuby. Nejprve je uvedena charakteristika zkoumaných obcí, poté analýza rozhovorů statutárních zástupců obcí. Následně je na základě rozboru uzavřených smluv provedena komparace zkoumaných obcí a vyhodnocení se zaměřením na platnou právní úpravu, podmínky užívání majetku oprávněnými osobami z hlediska jeho efektivního využití, zachování majetku a finančního přínosu do rozpočtu zkoumaných obcí. Na závěr provedeného výzkumu bylo ze získaných dat učiněno vyhodnocení, specifikovány rozdíly a navrženy nejvhodnější formy užívání obecního majetku.

Abstract:

This diploma thesis examines the subject of municipal property and its utilisation by municipal authorities. The thesis is divided into two parts, theoretical and application. In the theoretical part, a content analysis of legal files is performed and municipal property is defined. The definition of property is derived from the Act on Municipalities, the civil code. The basic principles relate to municipal assets, the range and variety of these assets and the way in which their accounting distribution is characterized. The thesis examines the administration of municipality property, specifically the competence of municipal bodies and the application by, and responsibility of, its management. It describes the specifics of acquisition and sales of municipal property, as well as the necessary legal requirements. It describes the specific processes involved in ensuring the legal validity of the management of municipal property. In the application part, the information derived from the theoretical part is put into practice. Research was conducted in three selected municipalities in the Central Bohemian Region, these being municipalities with extended powers in Kutná Hora - specifically the municipalities of Čestín, Vavřinec and Zbizuby. The thesis investigates the characteristics of the surveyed municipalities and provides analysis of interviews with statutory representatives. Subsequently, the concluded contracts are analysed, and the surveyed municipalities are evaluated and appraised with regard to applicable legislation, the conditions for use of property by authorized persons in terms of effective employment, preservation of assets and the financial contribution to the budget of the concerned municipalities. In conclusion, the thesis evaluates the obtained data, specifies the differences and proposes the most suitable forms of use of municipal property.
