Prevention and Liability for Damage in the Field of Nuclear Energy

Abstract:

The thesis is dedicated to cognition of very important part of legal environment, which is nuclear law. Although this area is not a separate branch of law, nevertheless it is its significant component. The thesis focuses on prevention and liability for damage in the field of nuclear energy. The initial pages discuss its origins, the sources of law as well as the basic concepts. The following section outlines a perspective into the use of nuclear energy together with the legal framework and provides a view into the most important international organizations. The subsequent section focuses on the legal and preventative requirements to ensure safety with regards to specific areas, mainly in Dukovany. The following section concentrates on the topic of the legal background of NPP. In this part the thesis also describes the absence of context in the current national legislation and details the changes that are part of the new bill of the Atomic Act. Finally, the thesis focuses on the liability of nuclear damage and thereafter the attention turns to another important part of nuclear industry, which is the management of radioactive waste.

Abstract:

Diplomová práca sa venuje poznávaniu veľmi dôležitej súčasti právneho prostredia, a to „jadrovému“ právu. Hoci táto oblasť nie je samostatným odvetvím práva, tvorí jeho významnú zložku. Práca sa tak zameriava na prevenciu a zodpovednosť na poli jadrovej energie. V úvodných stranách približuje jej počiatky, pramene práva a základné pojmy. Nasledujúca časť načrtne pohľad do využívania jadrovej energie spolu s právnym rámcom a poskytne i pohľad na najdôležitejšie medzinárodné organizácie. Následná časť sa zameria na právne a preventívne požiadavky k zaisteniu bezpečnosti JE s prihliadnutím na konkrétne oblasti v JE Dukovany. Ďalšia časť sa zameria na právne zázemie v JE. V rámci tejto časti práca neopomenie ani nedostatky v národnej úprave a popíše zmeny, ktoré sú súčasťou návrhu nového atómového zákona. V neposlednom rade sa práca upriami na zodpovednosť za jadrové škody a k záveru sa pozornosť ešte otočí k dôležitej súčasti jadrového priemyslu, a to k nakladaniu s rádioaktívnym odpadom.
