Abstract:

Na závěr bych problematiku znaleckého dokazování shrnula asi takto: Znalecká činnost má v dnešní době beze sporu velký význam jak pro moderní soudnictví, veřejnou správu, tak pro občany. Znalecké posudky zažívají boom, jelikož dochází k prudkému rozvoji vědy a techniky. Pro orgány činné v trestním řízení je stále náročnější posuzovat jednotlivé případy a často se bez spolehlivého fungování znalců neobejdou. Nežádoucím jevem je fakt, že věda a technika mají v současné společnosti velkou autoritu. Laická veřejnost, ale i orgány činné v trestním řízení znaleckým posudkům příliš důvěřují a zdráhají se k nim zaujmout kritický postoj. Na znalce jsou přenášeny stále širší okruhy otázek, k jejichž objasnění nejsou nutné odborné znalosti nebo ty, které mají právní povahu. Soudce je de facto zbavován části svých kompetencí a namísto soudního procesu vzniká ?znalecký proces?. V České republice se znalectví nachází ve velmi neutěšeném stavu a již několik let se lze setkat jak v odborných publikacích, v politických diskuzích, v judikatuře a v řadách samotných právníků a znalců se sílící kritikou. Ta se týká především právní úpravy, tj. zákon č. 36/1967 Sb., o znalcích a tlumočnících a prováděcí vyhláška Ministerstva spravedlnosti, která je značně zastaralá a vyžaduje zásadní reformu. Zesnulý český ombudsman Otakar Motejl před pár lety prohlásil: ?Soudní znalci ničí lidské životy!? Jeho reakci je nutné brát vážně, protože znalci nenesou patřičnou odpovědnost za chybně vyhotovený posudek. Současný trend je takový, že soudci bez znaleckého posudku téměř nerozhodnou. Takže nepravdivé posudky mohou způsobit velkou újmu na životech lidí, vůči kterým byl posudek podán. Za nezbytnou podmínku hodnocení odborné správnosti považuji transparentnost znaleckého posudku, tedy srozumitelnost pro laiky. Mnohdy se zdá, jako by si znalci vůbec neuvědomovali, že jejich posudek by měl zprostředkovat odborné poznatky nikoliv vědcům, ale i právníkům, orgánům činným v trestním řízení, též procesním stranám. Srozumitelnost textu je důležitá především pro obviněného, který by měl dostat možnost se zapojit do procesu dokazování a do hodnocení důkazů. Někdy méně znamená více a podle mě si znalci autoritu svých posudků nesrozumitelnou terminologií nezvýší. Ve větší části mé práce jsem se snažila přiblížit základní pojmy, se kterými se v pokročilém textu pracovalo a bylo tedy nutné je uvést na začátku, aby čtenář-laik porozuměl celé práci bez větších obtíží.

Abstract:

In conclusion, I would summarize the issue of expert testimony this way: In today?s world, expert activity has undisputably a great meaning for modern judiciary or public administration as well as for citizens. Expert testimonies are booming as science and technology are rapidly advancing. For organs active in prosecutions, it is increasingly becoming more difficult to judge individual cases and often they cannot manage without the help of experts. The great authority of science and technology in contemporary society can thus be seen as undesirable. The layman public and even organs active in prosecutions overly believe the expert testimonies and are reluctant to assume a critical stance towards them. Experts deal with increasing domains of questions, which do not concern the law or do not necessarily need specialist knowledge. The jury is as a matter of fact partly stripped of his competencies and instead of a trial, an ?expert process? occurs. In the Czech Republic, the field of expert opinion is found in a very disconsolate state and for a few years already, one can encounter increasing criticism in scientific publications, political discourse, the judisciary and also in the ranks of lawyers themselves. This concerns especially law adjustments, that is, Act No. 36/1967 Coll., concerning experts and interpreters and the executive ordinance of the Ministry of Justice, which is considerably outdated and requires fundamental reform. A few years ago, the deceased czech ombudsman Otakar Motejl declared: ? Judisciary experts destroy human lives!? It is necessary to consider his reaction, because experts do not carry appropriate responsibility for wrongly drawn testimonies. The current trend is such that judges almost cannot adjudge without an expert testimony. Thus, untrue testimonies can cause a great harm to the lives of the people against whom the testimony was filed. I consider the transparency of the expert testimony, and thus its comprehensibility for the layman, as an indispensable prerequisite of the appraisal of expert correctness. Often, it appears as if the experts do not realise that their testimony should convey scientific findings not to scientists, but also to lawyers, prosecution organs and the process sides. Most of all, the comprehensibility of the text is important for the accused who should have the opportunity to be involved in the process of testifying and the assesment of evidence. Sometimes less means more and I believe that experts will not increase the authority of their testimonies by unintelligible terminology. In the greater part of my work, I tried to zoom in on the basic terms, which I continued to use in the text and it was thus necessary to introduce them at the beginning for the layman-reader?s good understanding of the whole work. In the introduction, I mentioned testifying in the prosecution process, which is, together with the basic codes of the process and decision making, the most important process activity of the procesution organs. Further, I engaged in contemporary law modification in the Code of Criminal Procedure, meaning the constitutions which modulate the issue of expert testimony in the prosecution process. Within the frame of individual chapters,I took into account changes which were brought into the prosecution process by the legal amendment Act No. 265/2001 Coll., which in part enabled the sides in the prosecution process to make use of expert testimony (§ 110a TrŘ).
