Gender Mainstreaming in International Criminal Judiciary

Abstract:

Práce pojednává o zastoupení mužů a žen v rámci mezinárodních trestních soudů. Jejím cílem je zjistit, jakým způsobem jsou u vybraných soudů zastoupeni muži a ženy a jak se toto zastoupení měnilo v čase. Nejprve je představen teoretický koncept gender mainstreamingu, jeho počátky, vývoj a uplatnění v mezinárodních institucích a u mezinárodních trestních soudů. Poté je představeno pět vybraných soudů: Mezinárodní trestní tribunál pro bývalou Jugoslávii, Mezinárodní trestní tribunál pro Rwandu, Zvláštní soud pro Sierra Leone, Zvláštní tribunál pro Libanon a Mezinárodní trestní soud. U každého soudu jsou nejprve stručně představeny okolnosti jeho vzniku a poté vysvětleny způsoby, jakými daný soud postupuje při výběru svých soudců. Poslední část představuje analýzu, která byla sestavena na základě životopisných dat bývalých a současných soudců vybraných soudů. Výsledkem této analýzy je zjištění poměru soudců a soudkyň u jednotlivých soudů v průběhu jejich působení. Kromě vývoje situace u každého soudu jsou porovnány podobnosti a rozdíly mezi vývojem soudů navzájem.

Abstract:

The bachelor thesis deals with representation of men and women in international criminal courts. Its aim is to find out how men and women are represented in selected courts and how this representation has changed over time. First, the theoretical concept of gender mainstreaming, its origins, development and application in international institutions and international criminal courts are presented. Five selected courts are introduced: the International Criminal Tribunal for the former Yugoslavia, the International Criminal Tribunal for Rwanda, the Special Tribunal for Sierra Leone, the Special Tribunal for Lebanon and the International Criminal Court. For each court, the circumstances of its origin are briefly presented and then the way the court proceeds in selecting its judges is explained. The last part presents an analysis that was compiled on the basis of biographical data of former and current judges of selected courts. The result of this analysis is to determine the ratio of male and female judges of these courts during their operation. In addition to the development of the situation in each court, the similarities and differences in the development of individual courts are compared with each other.
