Necessary Defence as a Circumstance Eliminating Criminal Responsibility

Abstract:

The essence of this thesis is the focus on the issue of self-defense in the Czech Republic. Its aim is the overview of the respective conditions of this illegality-preventing circumstance, their excesses and their influence on this issue. The thesis also aspires to define and evaluate acting in the case of an attack and a defense, incorporating the use of the instruments of defense. Another part is the inquiry into a published case which makes up an entire chapter. The development of the institution of the right to self-defense will be illustrated in a historical retrospective from its very beginning in certain stages important for the area of the former Czechoslovakia until her division and the gradual transformation of this institution up to the present time. The last part of the thesis contains an inquiry into the Slovak institution of the right to self-defense and a subsequent comparison. The thesis is augmented with the judicial decisions which are being used to reflect on the application of the right to self-defense. One of the last chapters includes several themes of de lege ferenda devoted to the incorporation of martial arts; their inclusion in the law may serve for a lay reader as an illustration of the requirements of self-defense. The thesis incorporates especially the methods of induction, deduction, analysis and comparison.

Abstract:

Podstatou tejto práce je zamerať sa bližšie na problematiku a úpravu nutnej obrany v Českej republike. Cieľom je zhrnúť jednotlivé podmienky tejto protiprávnosť vylučujúcej okolnosti, vysvetliť excesy a ich vplyv na nutnú obranu, ohodnotiť a definovať konanie v prípade útoku a obrany, a tiež zohľadniť použitie obranných prostriedkov. Súčasťou je aj rozbor medializovaného prípadu, ktorému je venovaná samostatná kapitola. Vývoj problematiky inštitútu nutnej obrany načrtnem v rámci historického exkurzu od jeho počiatku v určitých etapách významných pre územie bývalého Československého štátu až po jeho rozdelenie, a postupné samostatné rozvinutie úpravy nutnej obrany do súčasnosti. Záver je venovaný rozboru slovenskej úpravy nutnej obrany a následnej komparácii. práca je doplnená rozhodnutiami právnych inštitúcií, prostredníctvom ktorých som sa snažila zreflektovať uplatňovanie nutnej obrany. Súčasťou jednej zo záverečných kapitol sú aj námety de lege ferenda venované úprave bojových umení, ktoré by podľa môjho názoru mohli svojím zavedením vniesť do trestnoprávnej úpravy pre čitateľa - laika určité osvetlenie podmienok nutnej obrany. V práci som využívala najmä metódy indukcie, dedukcie, analýzy a komparácie.
