Combating the Financing of Terrorism by Banks

Abstract:

Combatting terrorism financing or effort to prevent terrorist organizations from obtaining financial resources is an integral part of effective combating terrorism itself. Suppression of terrorism financing is usually connected to suppression of money laundering because of characteristic similarities between these illegal activities. Significant development of combating of terrorism financing started in the last years of 20th century with adoption of The International Convention for the Suppression of the Financing of Terrorism and following adjustment of national legislation. According to nature of their business banks and financial institutions play a key role in combating terrorism financing. Effective performance of banks in this area requires adoption of and adherence to complex system of rules and procedures. These procedures covered in the last chapters represent the main focus point of my diploma thesis, which comes after clarifying the issue of terrorism financing and introduction of current legal framework in the first chapters

Abstract:

Boj proti financovaniu terorizmu, čiže snaha o znemožnenie získavania finančných prostriedkov v prospech teroristických organizácií je neoddeliteľným prvkom efektívneho boja proti samotnému terorizmu. Potláčanie financovania terorizmu sa uskutočňuje väčšinou v spojitosti s potláčaním legalizácie výnosov z trestnej činnosti nakoľko ide o charakterovo veľmi podobné nezákonné aktivity. K významnému rozvoju boja proti financovaniu terorizmu dochádza od posledných rokov 20. Storočia v súvislosti s prijatím Medzinárodného dohovoru o potláčaní financovania terorizmu a následnému prispôsobeniu vnútroštátnej legislatívy. Z podstaty svojej činnosti kľúčovú úlohu v boji proti financovaniu terorizmu zohrávajú banky a finančné inštitúcie. Efektívne pôsobenie bánk v tejto oblasti si vyžaduje prijatie a dodržiavanie komplexného systému pravidiel a postupov. Konkrétne postupy obsiahnuté v posledních kapitolách tvoria ťažisko diplomovej práce, ktoré nasleduje po objasnení problematiky a priblížení súčasného normatívneho rámca v prvých kapitolách.
