Survey taxes in the tax procedure.

Abstract:

Předmětem mé diplomové práce je vyměřování daní, jakožto jedna z nedílných a důležitých fází správy daní. Význam tohoto stadia daňového procesu spočívá v tom, že v průběhu vyměřovacího řízení dochází k vypočtení základu daně a následnému stanovení konečné daňové povinnosti. Výsledkem vyměřovacího procesu je rozhodnutí, na základě kterého je daňovému subjektu uložena povinnost zaplatit vyměřenou a předepsanou daň. Vyměřovací řízení proto vytváří předpoklady pro uplatnění dalších fází správy daní, neboť bez existence možnosti daň vyměřit by daňovému subjektu nemohla být uložena ani povinnost tuto daň odvézt příslušnému správci daně. Je zde patrná úzká souvislost a vliv především na fázi inkasní, kdy se daňový subjekt dostává do pozice daňového dlužníka a nesplní-li svou zákonnou povinnost, je správce daně oprávněn zahájit daňovou exekuci k vymožení daňového nedoplatku. Záměrem mé práce bylo zhodnotit jak může správce daně vyměřit a předepsat daňovou povinnost. Proto jsem se zaměřila pouze na samotné vyměřování daní, přičemž jsem se pokusila nastínit i některé sporné momenty, jenž mohou v průběhu tohoto procesu nastat. Mou snahou bylo rozebrat, jakým způsobem správce daně vůči daňovému subjektu postupuje a co vše je ve vztahu k tomuto subjektu oprávněn požadovat.

Abstract:

Taxes represents one of the most significent component flowing into the state budget, although not the only one. In the district of the Czech Republic taxes can be introduced only by operation of law. This principle of statutory regulation of the collection of taxes results from the Charter of rights and freedom. The theme of my diploma thesis is tax assessment as inseparable and important part of the tax procedure. The meaning of this stadium of the administration of taxes consists in the fact that during the tax assessment the final tax liability is calculated and after that also levied to the acount of the competent tax administrator. The tax procedure is finished by decision under which rights and duties can be imposed to the taxable unit. Therefore tax assessment is an indispensible prerequisite for implementation of another parts of the administration of taxes. First of all there is obvious connection with cllection part where the taxable unit becomes the tax debtor and if he fails to fulfil his statutory duty the tax administrator is entitled to commence tax execution on drawing out the tax deficiency. The baxic legal regulation in the area of the administration of taxes is Act. N. 337/1992 Coll. Administrative tax and charge procedure Act. This statute contains the body of rules regulating the advance of the tax administrator, his entitlements as well as rights and duties of the taxable unit. My diploma thesis is devided into four parts including the conclusion. The aim of my diploma thesis was to consider existing ways wchich are used by the tax administrator to find oud the tax liability. In my thesis I also tried to introduce some controversial moments that can occure during the tax procedure. The issue of tax can be sometimes seemed as complicated and demanding. In virtue of that fact some taxable unit underestimate the knowledge about tax regulations which leads to conflict wiht the tax administrator. This was the reason why chosing this topic – to point up the shceme of Administrative tax and charge procedure Act and to consider rights nad duties as well as possibilities of both opposite standing sides.
