The legal regulation of joint and shared custody in the Czech Republic compared to selected EU countries

Abstract:

Diplomová práce se zabývá právní úpravou společné a střídavé péče v České republice ve srovnání s vybranými zeměmi EU (Velká Británie, Belgie a Polsko) Cílem práce je shromáždit současný stav a praktickou funkci společné a střídavé péče v České republice a porovnat je s právní úpravou ve vybraných zemích EU. První kapitola se zabývá prameny práva, druhá se věnuje péčí o dítě v rámci rodičovské zodpovědnosti (část této kapitoly je zaměřena na definici hlavních pojmů jako rodina, dítě a jeho nejlepší zájmy, část je zaměřena na rodičovskou zodpovědnost). Čtvrtá kapitola se věnuje společné a střídavé péči v České republice - od jednotlivých definicí, přes krátkou historii jejich právní úpravy v České republice až po judikaturu Ústavního soudu ČR. Je to právě judikatura Ústavního soudu, která je pro tuto kapitolu rozhodující, neboť poukazuje na vývoj a různé přístupy. Poslední kapitola této práce se zabývá stručným popisem společné a střídavé péče ve vybraných zemích Evropské unie - Velké Británie, Belgie a Polska a jejich srovnání s právními předpisy v České republice. .

Abstract:

This thesis deals with legal regulation of shared and joint custody in the Czech Republic compared to selected EU countries (Great Britain, Belgium and Poland) The aim of the thesis is to collect the current status and practical function of shared and joint custody in the Czech Republic and to compare them with the legal regulations of selected EU countries. The first chapter deals with the sources of law, the second deals with the care of the child within parental responsibility (part of this chapter focuses on the definition of main terms as family, child and his / her best interests, section on parental responsibility). The fourth chapter deals with shared and joint custody in the Czech Republic - from individual definitions, through a short history of their legal regulation in the Czech Republic to the case law of the Constitutional Court of the Czech Republic. It is the case law of the Constitutional Court, which is decisive for this chapter, as it points to developments and different approaches. The last chapter of this thesis deals with a brief description of shared and joint custody in selected countries of the European Union - Great Britain, Belgium and Poland and their comparison with the legislation in the Czech Republic. .
