Employment Relationship for the Limited Period - the History of Legal Regulation

Abstract:

Tato diplomová práce zachycuje vývoj právní úpravy pracovního poměru na dobu určitou od roku 1945 do současnosti. Pracovní poměr na dobu určitou coby institut českého (dříve československého) pracovního práva prodělal od roku 1945 významné koncepční změny. Právní úprava tohoto pracovního poměru, původně založená na široké smluvní volnosti jeho účastníků, se postupem času mění ve striktní regulaci, která se projevuje zejména zákonem stanovenou maximální dobou trvání pracovního poměru na dobu určitou a četností jeho opakování mezi týmiž účastníky. Poté zákonodárce po určitá léta poskytuje právní úpravou pracovního poměru na dobu určitou jeho účastníkům či jeho budoucím účastníkům větší prostor pro uplatnění smluvní volnosti. Tato smluvní volnost je však později (i v současnosti) opět omezena, a to v souvislosti s implementací právních předpisů Evropských společenství do českého právního řádu, přičemž se tak děje v míře větší, než je požadováno směrnicemi Evropských společenství analyzovanými rovněž v této práci.

Abstract:

This dissertation records the development of the employment relationship for the limited period regulation from 1945 to nowadays. The employment relationship for the limited period as an institute of the Czech (in the past: Czechoslovak) labour law has undergone significant conception modifications since 1945. This employment relationship regulation was originally based on its participants´ wide contractual freedom. In the course of time it changed into the stringent adjustment which became evident especially in the maximal lenth of employment relationship for the limited period fixed by a law and in being remade between the same participants. Then the lagislator gave his present and future participants an oportunity to exercise the contractual freedom by the regulation of the employment relationship for a certain period for some years. But this contractual freedom was limited again (also nowadays) especially relating to the implementation of European Community regulations into the Czech rule of law. It happens to a larger extent than it is claimed by the European Community guidelines which are also analysed in this dissertation.
