Resident Register Law in Relation to the Administration Code

Abstract:

Práce je určena především subjektům, které se zabývají vztahem mezi zákonem o evidenci obyvatel a správním řádem. Definuje vazbu obou právních předpisů a vyhodnocuje přínos zákona o evidenci obyvatel pro vedení správního řízení. Upozorňuje na problémový vztah zákona o evidenci obyvatel a správního řádu, zejména s ohledem na údaj o trvalém pobytu, kdy dochází k nesouladu mezi oficiálně nahlášeným a skutečným místem trvalého pobytu. Práce naznačuje možnosti koordinace subjektů využívajících osobních údajů v rámci správního řízení. Věnuje se také legislativě, která by měla být vázána spíše na faktické bydliště než na formální místo trvalého pobytu.

Abstract:

This thesis is primarily meant for those subjects engaged in the relation between Resident register law and the administration code. It defines the links of both legal provisions and evaluates possible assets of Resident register law in conducting administrative procedure. The thesis points out the problematic relation between Resident register law and the administration code, especially with respect to the entry stating people´s permanent residence, resulting in a discrepancy between the officially reported and the actual place of permanent residence. The thesis suggests possibilities for mutual coordination of subjects using personal data within the framework of the administrative procedure. It also deals with legislature which should be bound to the actual rather than the formal place of permanent residence.
