Taxation of collective investment with emphasis on investment funds, investment companies and pension funds

Abstract:

Tato práce se zabývá zvýhodněnými podmínkami subjektů kolektivního investování, které jsou často využívány pro daňové plánování. Záměrem práce je informovat o možnostech využití těchto subjektů pro účely daňové optimalizace. První část se zabývá rozvojem kolektivního investování v České republice a jeho vztahem k vývoji zákonů. Ve druhé kapitole jsou srovnány investiční podmínky pro jednotlivé typy subjektů v ČR, a to podle současných zákonů. Konktrétně se jedná o investiční fondy, investiční společnosti a její podílové fondy a penzijní fondy. Výsledky srovnání jsou následně interpretovány ve formě doporučení vhodné právní formy investičního subjektu. Třetí část definuje rozdíly podmínek v České republice a ve vybraných zemích Evropské unie, konkrétně v Lucembursku a Irsku. V závěru práce hovoří o plánovaných změnách v zákonech České republiky, které souvisejí s kolektivním investováním a jejich možném vlivu na výběr vhodného investičního prostředí.

Abstract:

This bachelor thesis focuses on advantages of the collective investment subjects that are often used for tax optimization planning. The purpose of this work is to inform about their possible use for the mentioned tax planning by regular investors. The first part examines the relation between development of collective investment and alterations made in the Czech law. In the second chapter, individual subjects are compared according to current laws. Specifically this part deals with investment funds, investment companies and pension funds. The results are then interpreted in a form of an advice for a convenient legal form for different types of investors. The third chapter defines the differences between Luxembourg, Ireland and the Czech Republic in terms of investment environment. Lastly the final part of this thesis describes the changes in the Czech law that are supposed to come into force in the near future and talks about possible influence on the selection of appropriate country for investment subjects.
