Abstract:

Nájemní smlouva je upravena v zákoně č. 89/2012 Sb., občanský zákoník. Nájemní smlouva se ale vyvíjela již od doby starověkého Říma. Nájemní smlouva je závazek pronajímatele, kterému je na určitou dobu omezen výkon jeho vlastnického práva ve prospěch nájemce, který se stává držitelem bytu nebo domu nebo jejich částí. Předmětem nájemního vztahu může být jakákoliv věc, nicméně nejčastěji se jedná o věci nemovité. Zásadní skutečností, pokud jde o nájem bytu, je ochrana, kterou zákon poskytuje nájemci jako slabší straně (např. při výpovědi nájmu apod.). Teoretická část práce je zaměřená na historický vývoj institutu nájmu, práva a povinnosti pronajímatele a nájemce a vznik a zánik nájmu. V centru pozornosti praktické části stojí dvě aktuální otázky. První z nich je skutečnost, zda zavedením smluvní pokuty je snížena ochrana nájemce jako slabší strany a druhá, zda přijetím zákona č. 209/2020 Sb. v souvislosti s koronavirovou pandemií nedošlo k porušení ústavních, když za omezení vlastnického práva pronajatých bytových prostor nebyla poskytnuta náhrada.

Abstract:

The lease agreement is regulated in Act No. 89/2012 Coll. (The Civil Code). However the lease has been evolving since the time of ancient Rome. A lease is an obligation of a landlord who is limited in time to exercise his right of ownership in favor of a tenant who becomes the owner of an apartment or house ortheir parts. The subject of a rental relationship can be anything, but most often it is a real estate. A fundamental fact when it comes to renting an apartment is the protection that the law provides to the tenant as the weaker party (when terminating the lease etc.). The theoretical part of the work is focused on the historical development of the institute of lease, the rights and obligations of the landlord and tenant and the origin and terminativ of the lease. The focus of the practical part is two current issues. The first of them is the fact whether the introduction of a contractual penalty reduces the protection of the tenant as a weaker party and the second whether the adoption of Act No. 209/2020 Coll. There was no constitutional violation in connection with the coronavirus pandemic, when no compensation was provided for the restriction of the ownership right of the rented residential premises.
