Legal Status of Tibet

Abstract:

Diplomová práce se zabývá právním postavením Tibetu. V roce 1950 vtrhly do Tibetu vojenské jednotky čínské Lidově osvobozenecké armády, aby „zachránily tři miliony Tibeťanů před imperialistickým útlakem“. Dle tvrzení tibetské exilové vlády byl Tibet do okamžiku invaze v roce 1950 plně nezávislým státem. Čínská Ústřední lidová vláda svůj vpád ospravedlňuje historickými nároky na Tibet a tvrdí, že byl vždy její integrální součástí. Cílem práce je zhodnotit otázku nezávislosti Tibetu z hlediska mezinárodního práva a posoudit, zda lze čínskou invazi hodnotit jako protiprávní akt agrese a okupace. Práce vychází z protichůdných argumentů tibetské exilové vlády a Číny a zabývá se postojem mezinárodního společenství. Praktické otázky jsou hodnoceny na základě právní úpravy mezinárodněprávní subjektivity státu, institu uznání státu v mezinárodním společenství, jednotlivých právních forem vzájemné závislosti států, smluvního práva a institutů agrese a okupace.

Abstract:

Diploma thesis deals with the legal status of Tibet. „China’s People’s Liberation Army” invaded Tibet in 1950 to „save three million of Tibetans against the imperialist subjection“. According to the official expression of the Tibetan Government in exile Tibet was fully independent state prior to 1950. China’s People’s Central Republic has exculpate its invasion by historical claims to Tibet and has argued that Tibet had always been an integral part of her. The aim of the work is to evaluate the issue of Tibet’s independence according to international law and to review whether it’s possible to assess the Chinese invasion as the illegal act of aggression and occupation. The thesis result from contradictory arguments of the Tibetan Government in exile and of China and treats of the attitude of international community. Practical matters are evaluated on the basis of legal regulations of the statehood in international law, of the institute of recognition of a state in international community, of particular legal forms of mutual dependence of states, of contractual law and of institutes of aggression and occupation.
