The role of the Commission in infringement proceedings of the Treaty on the Functioning of the European Union

Abstract:

Předmětem této práce je analýza institutu řízení pro porušení Smlouvy o fungování Evropské unie a úloha Komise v průběhu celého procesu. Práce má tři základní cíle. První část klade důraz na zhodnocení efektivity vynucování práva na národní, mezinárodní a evropské úrovni. Druhá část práce se zaměřuje na samotnou úlohu Komise v řízení pro porušení smlouvy, nastiňuje vývoj institutu a rozebírá jednotlivé fáze řízení. V této souvislosti tvrdím, že řízení pro porušení je vysoce efektivní nástroj Komise a že ta má nezastupitelnou úlohu ve všech fázích procesu. Třetí část posuzuje nové aspekty řízení po vstupu Lisabonské smlouvy v platnost a jejich využití v rámci řízení pro porušení Smlouvy; zejména se orientuje na nové ustanovení článku 260 SFEU, a to na odstavec třetí. Práce vysvětluje proč je toto ustanovení problematické a byrokratické, i když v této souvislosti dosud nebyl vydán žádný rozsudek. Na závěr bylo nutno se zaměřit i na nedostatky předmětného řízení, rozebrat je a navrhnout zlepšení.

Abstract:

The objective of this work is to analyse the institute of infringement proceeding of the Treaty on the Functioning of the European Union and the Commission's role in the whole process. The work has three main goals. The first part emphasizes the evaluation on the effectiveness of law enforcement at the national, international and European level. The second part focuses on the actual role of the Commission in infringement proceeding, outlines the development of the institute and discusses the different parts of the proceedings. In this context, I claim that the infringement procedure is a highly effective tool and that the Commission has a vital role in all stages of the process. The third part regards the new aspects of the Lisbon Treaty, and their use in the context of infringement proceedings; mainly it focuses on the new provisions of Article 260 TFEU, and paragraph three. This work explains why this provision is problematic and bureaucratic, although in this context has not yet been issued any judgment. In conclusion, it was necessary to focus on the shortcomings of the present proceedings, breaking them and suggest improvements.
