Abstract:
Developerská smlouva je smlouva uzavíraná mezi developerem a investorem, tudíž mezi dvěma podnikateli při výkonu jejich podnikatelské činnosti. Jako taková spadá pod úpravu řízenou obchodním zákoníkem, a to jako relativní obchod dle § 261 odst. 1. ObchZ. The development contract is a contract concluded between a developer and a stakeholder, i.e. between two entrepreneurs by conducting their business. As such it falls within regulation of the Commercial code as so called „relative contract“ (§ 261 par. 1).
