Public Preservation of Historical Monuments in the Czech Republic in the Position of the Acting Authority

Abstract:

V mé práci se zabývám státní památkovou péčí v ČR v postavení dotčeného orgánu. Úvod práce je obecně zaměřen na již zmíněné vybrané pojmy, jejich podrobné vysvětlení a chybí ani přehled právní úpravy, také jsem zařadila historii památkové péče. Následná kapitola je zaměřena na dotčené orgány, opět vymezení pojmů a činnost těchto orgánů. Dále jsem se věnovala péči o kulturní památky. Další kapitolu jsem věnovala problematice prohlášení věci za kulturní památku. Následná kapitola se věnuje problematice financování kulturních památek. Moji práci uzavírá kapitola věnovaná opatření při porušení povinnosti na úseku památkové péče. V závěru práce jsem uvedla zajímavost o koncepci daňových a finančních nástrojů v rámci návrhu věcného záměru zákona o památkovém fondu. Cílem práce je přispět k osvětlení složité problematiky ochrany kulturního dědictví na území České republiky, se všemi rozpory a nedokonalostmi jež obsahuje, ale i s ohledem na její celkový přínos.

Abstract:

I deal with the national historic preservation in the Czech Republic from the viewpoint of the involved body in my work. The introduction of the work focuses generally on the selected notions mentioned already and on their detailed explanation including the summary of the legal regulations. I have also included the historic preservation history. The next chapter focuses on the involved bodies and qualifies again the definitions and their activities. Hereafter, I pay attention to the cultural landmarks preservation. I dedicated the next chapter to the issues of declaring a subject a cultural landmark. The following chapter is on financing cultural landmarks. The conclusion of my work describes the measures taken at breaching an obligation within the historic preservation. At the very end of my work, I mention the concept of tax and finance tools within the motion of the subject matter of Historic Preservation Act as a matter of interest. It is the objective of this paper to contribute to the clarification of the complex problems of preserving the cultural heritage at the territory of the Czech Republic with all the contradictions and imperfections it contains but also with regard to its overall benefits.
