Role of national parliaments in european legislative procedure

Abstract:

„Úloha národních parlamentů v evropském legislativním procesu“ se zdá být na první pohled jednoduché téma, avšak vzhledem k odlišnému postupu projednávání evropských záležitostí jednotlivými parlamenty členských zemí tomu tak není. Evropský legislativní proces je pevně stanoven primárním právem a tudíž se zde žádné odchylky vyskytnout nemohou. Evropské sekundární právo je přijímáno spolurozhodováním, spoluprací, konzultací a souhlasem orgány ES. Jedním z prvních kroků zapojení národních parlamentů do rozhodovacího procesu v Evropské unii bylo zavedení přímých voleb do Evropského parlamentu v roce 1979, dále pak v roce 1989 vznikla Konference výborů pro evropské záležitosti parlamentů EU - COSAC. Dalším mezníkem byl v roce 1997 Protokol o úloze národních parlamentů v EU připojený k Amsterodamské smlouvě a největší posílení role národních parlamentů zajisté najdeme v zatím neratifikované Lisabonské smlouvě. Parlamentní kontrola v Dánsku je charakteristická udělováním negociačního mandátu, silná pozice finského parlamentu zas výrazně ovlivňuje postoje vlády, rakouský parlament tzv. „svazuje“ spolkové ministry v Radě a Česká republika má v horní i dolní komoře výbor EU, který kontroluje evropské právní akty ve stadiu jejich vzniku.

Abstract:

The role of national parliaments in the European legislative procedure seems to be like easy topic but it is not because of the different procedure of European affairs negotiation by the European national parliaments. The European legislative procedure is closely set by primary law and no departures are there. European secondary law is accepted by codetermination, cooperation, consultation and understanding of the EU authorities. The first step of the involving the national parliaments in the decision-making process in the EU was direct election to the European parliament in 1979, followed by the Conference of Community and European Affairs Committees of Parliaments of the European Union - COSAC in 1989. The next step was the Protocol on the Role of the National Parliaments in the European Union added to the Treaty of Amsterdam and we can find the maximum strengthening of the role of national parliaments in the till now unratified Treaty of Lisbon. Danish parliamentary control of EU decision-making is typical of mandate procedure, Finnish parliamentary strong position influences on the government position, Austrian parliament binds Federal Ministers in the Council and the Czech Republic has European Committee in the Second Chamber as well as Chamber of Deputies. Both Committees check making European acts.
