„Trials do not yield profit“. Disputes of the small towns` inhabitans of the Pardubice estate in th 16th and 17th century

Abstract:

Předkládaná dizertace se zabývá spory obyvatel městeček pardubického panství z 16. a 17. století. Studie obsahuje kvantitativní analýzu 642 sporů vztahujících se k prostředí městeček. Autorka na základě typologie pří sleduje zastoupení jednotlivých typů sporů a proměny jejich četnosti v čase. Při kvalitativní analýze pracuje i s dalšími přibližně 200 konflikty, jejichž aktéry byli obyvatelé vesnic pardubického panství či měšťané z poddanského města Pardubic. Jedním z ústředních bodů práce je sledování způsobů řešení konfliktních situací, a to soudního, násilného a smírného řešení. Zaznamenanými spory se v určité fázi zabývaly soudní instituce, které se sporné strany opakovaně snažily přesvědčit k ukončení sporů a usmíření. Kromě průběhu soudního řízení se tak práce podrobněji zabývá právě smírným řešením pří a způsoby, kterými ho bylo dosaženo. Dalším cílem byla analýza konfliktních vztahů, které autorka sleduje ve třech úrovních, jež se odrážejí ve struktuře práce. Nejprve se zaměřuje na spory poddaných s autoritami, kdy si všímá vztahu vrchnosti, vrchnostenských úředníků, městských rad a rychtářů, a poddaných. Na základě konfliktů, k nimž zejména v prostředí městeček docházelo, sleduje vztahy těchto aktérů a jejich role v mocenských strukturách panství. Druhou sledovanou úrovní byly sousedské vztahy. Práce se soustředí podrobněji na tři základní sporné oblasti, a to násilí, čest a majetek, a všímá si okolností vzniku těchto sporů a jejich průběhu. Třetí úrovní byla oblast rodinných a partnerských vztahů, kde se autorka zaměřuje na dědické spory, manželské konflikty a spory plynoucí z mimomanželského sexuálního života. Prací prostupuje otázka způsobu udržování sociálního řádu na panství. Autorka v této souvislosti upozorňuje na uzavírání tzv. přátelských smluv, které obsahovaly sankci pro případ nedodržování smírné úmluvy, na zaručování některých provinilců a mírné trestání. Dále si všímá způsobů, kterými bylo dosahováno internalizace požadovaných norem chování u jednotlivců. Docházelo k ní hlavně prostřednictvím nátlakových prostředků a hrozby trestů, které s sebou nesly poškození vlastní pověsti a cti a někdy také majetkovou újmu. Zejména možné majetkové postihy měly jednotlivce přesvědčit k respektování otcovské autority, ale také vrchnosti, základních církevních svátostí a morálky.

Abstract:

The thesis deals with the disputes of inhabitants living in the Pardubice estate small towns from the 16th and 17th century. The study contains quantitative analysis of 642 disputes related to the milieu of small towns. On the basis of the typology of suits, the author pursues frequency of separate types of conflicts and changes in their numbers. As she deals with qualitative analysis, she works also with other 200 suits whose participants were villagers from the Pardubice manor and burghers of the Pardubice town. The work focuses on the ways in which conflict situations were solved, including judicial, amicable and violent conflict solving. In a particular phase, judicial institutions dealt with analysed disputes and they repeatedly tried to persuade parties to settle and to end the conflict. Apart from the course of lawsuit, the author deals in detail with amicable settlements of disputes and with ways through which these settlements were achieved. Another aim of the work is the analysis of conflict relations which author fellows in three levels reflecting in the structure of the work. First of all, the author focuses on the relationship among the authorities – seigniorial clerks – town councils and reeves – serfs. On the basis of conflicts which occurred mainly in the background of the small towns, the author follows relationships among these participants and their roles in the power structures of the manor. Neighbourly relations were the second pursued level where the author follows in detail three main disputed domains such as violence, honour and property. She pays attention to the circumstances of these disputes and their development. The third level was the area of family and partnership, in which the author focuses on the disputes concerning legacy, marital conflicts and controversies arising from extramarital sexual life. The issue of the way in which social order was preserved at the manor permeates through the whole work. As to this matter, the author points out the closing of amicable contracts, which contained sanction for the case of non-abidance of these agreements; binding over and recognisances of some wrongdoers for a good manner, and also moderate punishment. She aims at the ways with which the internalization of desired norms of behaviour was achieved by individuals. It occurs mainly through coercive means and threats of penalties which took with them injury of reputation and honour and sometimes also property damage. Mainly through possible property injuries, the individuals should be induced to the respect for paternal authority, but also for the authority of the lords, principal ecclesiastical sacraments and morality.
