The Contract of Purchase and Exchange Agreement /Comparison/

Abstract:

Diplomová práce se zabývá římskoprávní úpravou smlouvy kupní a smlouvy směnné, kterou srovnává s právem platným v České republice. V první kapitole jsou popsána pravidla a instituty římského práva vztahující se k oběma smluvním typům, druhá kapitola potom provádí jejich srovnání s normami obsaženými v občanském zákoníku, přičemž nejprve charakterizuje současnou úpravu, a poté se zaměřuje na případné podobnosti a odlišnosti. Třetí kapitola řeší vliv rakouského obecného zákoníku občanského a osnovy občanského zákoníku z r. 1937 na podobu nového občanského zákoníku.

Abstract:

This thesis deals with the principles of Roman Law applicable to the purchase contract and the exchange agreement, which compares with the law in force in the Czech Republic. The first chapter describes the rules and institutions of Roman law relating to both contractual types, the second chapter then makes a comparison with the standards contained in the Civil Code; first of all it characterizes the current legislation, and then it focuses on the possible similarities and differences. The third chapter discusses the influence of the Austrian Civil Code and the proposal of the Civil Code of 1937 to the form of the new Civil Code.
