The Status of the Suspected in Criminal Proceedings

Abstract:

Tato práce popisuje postavení podezřelého, jakožto osoby, proti které vede trestní řízení, s odkazem na jeho základní práva, kterými disponuje a která mu orgány činné v trestním řízení musí umožnit. V úvodu bakalářské práce se autor věnuje samotnému smyslu a účelu trestního řízení a uvádí základní právní předpisy, ze kterých vychází. Nechybí zde ani stručný pohled do historie trestního řízení od roku 1950, se zaměřením na respektování základních práv těch osob, proti kterým směřují úkony v trestním procesu. Pozornost je věnována také subjektům tohoto řízení se zaměřením na jejich postavení a funkci v trestním procesu a vzájemné odlišení těchto osob. Následně jsou zde detailně popsána základní práva obviněného, zejména proto, že jsou, až na vyjímky, totožná, respektive obdobná, jako práva podezřelého ve zkráceném přípravném řízení. Jak již napovídá téma této bakalářské práce, její převážná část je věnována osobě podezřelého a jeho postavení v systému trestního práva. Proto je také stěžejní částí práce přípravné řízení a zejména jeho část upravující postup před zahájením trestního stíhání, která charakterizuje osobu, proti níž se řízení vede, jako podezřelého, jakož i realizace zkráceného přípravného řízení před podáním návrhu na potrestání soudu. Smyslem této práce není pouze vymezení práv a povinností takové osoby, ale i rozbor jednotlivých institutů upravených trestním řádem, které se proti ní uplatňují. Obsahem práce zachycujícím postavení podezřelého v trestním řízení je tedy mimo jiné vysvětlení dvou základních institutů a sice zadržení a zkráceného přípravného řízení, ve kterých jsou práva a povinnosti podezřelého popsány, stejně tak jako postup orgánů činných v trestním řízení při realizaci těchto úkonů. Zde se autor v některých otázkách věnuje také porovnání práv podezřelého s právy obviněného, proti němuž bylo zahájeno trestní stíhání. V závěru práce autor hodnotí dosavadní právní úpravu a uvádí příkladmo návrhy na její zlepšení a odstranění nedostatků. Práce je stručným vstupem do problematiky, která je odrazem trestní politiky naší země a charakterizuje stupeň právní jistoty při řízení v trestních věcech, zejména z pohledu osoby, proti které se uplatňuje postup podle trestního řádu a zachycuje vše podstatné, co může podezřelý ze spáchání trestného činu v přípravném řízení očekávat.

Abstract:

This work represents a status of a suspected person as a person against whom is a criminal proceedings conducted with the basic rights ,which has to be allowed by the law enforcement authorities. At the beginning of the Bachelor’s work the author considers the mening and purpose of the criminal proceedings. He presents a basic legal regulations which he draws from. There is also a brief description of the historical criminal proceeding from 1950. It is focused on the basic rights respecting. This rights have all people against whom is the criminal proceeding conducted. An attention is also paid to the subjects of this proceeding,focused on their status and function in the criminal proceeding and differentation of these persons. Consequently there are defined the basic rights of the accused person,mainly because they are usually the same as the rights of the suspected person in the short preliminary proceeding. As according to the topic of this work it is mainly focused on the suspected person and his status in criminal law system. That’s why the major section is the the preliminary procedure and the part which sets up the proceeding before the criminal prosecution initialization. It describes a suspected person and preliminary procedures implementation before a punishment proposal. The purpose of this work isn’t just the statement of discretions and duties but also an individual institution analysis which are adjusted by the Rules of criminal Procedure. Besides the status of suspected person in criminal proceeding there is another purpose of this work. There is an explanation of a two institutes. The one is the detention and the short preliminary procedure. There are described the discretions and duties of the suspected person. The other is the procedure of the law enforcement during the implementation of these operations. Author compares the right of the suspicious person with the right of the accused person against whom was the criminal prosecution initiated. At the end of this work there is a present legal regulations measurement. There are some suggestions for the improvement and deficiencies elimination. This work is a brief description of a criminal policy in our country. It characterizes the certainity while a criminal procedures. It shows what can the suspicious person expect during the preliminary procedures.
