Formation of a marriage between a citizen of the Czech Republic and a citizen of a foreign nationality in the territory of the Czech Republic and the possibility of granting citizenship of the Czech Republic.

Abstract:

Lidská společnost je od svého počátku tvořena společenskými skupinami, které vycházely se základního pojetí, a to ze vztahu mezi mužem a ženou. Vzájemné soužití muže a ženy již v počátcích naší společnosti se určitým způsobem ritualizoval, a to podle specifického kulturologického prostředí, ze kterého vychází institut manželství jako soužití muže a ženy. Manželství je v současné době nedílnou součástí právního prostředí České republiky, která je historickým nástupcem předchozích státních útvarů neboli systémů. Na základě historických vazeb, které jsou úzce provázaný kulturně-společenskými tradicemi na území našeho státu. Práce se zaobírá pravoplatným vznikem manželství v jeho legislativním prostředí. Základními zákonnými formami uzavíraní manželství jsou občanský sňatek a církevní sňatek (státem uznané církve či církevní společnosti). Tyto dvě základní formy vzniku manželství jsou v práci charakterizované, a to nejen po legislativní stránce, ale i rovněž jsou zmíněny historické kontexty, které dokreslují složitost daného tématu. Obě formy vzniku manželství, tedy občanské i církevní, mají rovnocenné právní i společenské postavení. Česká republika se v současné době stává cílovou a zájmovou zemí pro cizí státní příslušníky, kteří mají v úmyslu dlouhodobě setrvávat na území České republiky, případně uzavřít manželství s českým občanem, a to formou občanského nebo církevního sňatku. Vznik manželství mezi občanem České republiky a cizím statním příslušníkem má svá specifika, která jsou výhradně upravovaná zákony upravující tuto problematiku. Je však nutné uvést, že vznikem manželství s cizím státním příslušníkem nevzniká právní nárok na udělení státního občanství České republiky. Udělení státního občanství České republiky cizímu státnímu příslušníkovi je samostatný legislativní proces, který není přímo spojen se vznikem manželství, ale manželství je považováno za významný, ale nikoliv za rozhodující aspekt při udělení státního občanství České republiky.

Abstract:

Since the very beginning, human society has consisted of social groups based on the concept of a relationship between a man and a woman. The mutual coexistence of a man and woman has been ritualised since the beginning of our society, according to the specific cultural background on which the institute of marriage, as the coexistence of a man and a woman, is based. Marriage is currently an integral part of the legal environment of the Czech Republic, which is the historical successor of previous state departments or systems, based on historical ties that are closely intertwined with cultural and social traditions in our country. This thesis deals with the legal origin of marriage in its legislative environment. The basic legal forms of marriage are civil marriage and church marriage (a state-recognized church or church society). This thesis characterises these two basic forms of marriage, not only in terms of legislation, but also with regard to historical contexts that illustrate the complexity of the topic. Both forms of marriage, civil and church, have equal legal and social status. The Czech Republic is currently becoming an interesting destination country for foreign nationals who intend to remain in the Czech Republic for a long time, or enter into marriage with a Czech citizen in the form of a civil or church marriage. A marriage between a Czech citizen and a foreign national has its specifics, which are exclusively regulated by laws governing this issue. However, it should be noted that a foreign national does not gain the legal right to be granted Czech citizenship upon marriage to a Czech citizen. The granting of Czech citizenship to a foreign national is a separate legislative process that is not directly connected to marriage; marriage is considered an important but not decisive aspect in the granting of Czech citizenship.
