Abstract:

Jednání mající charakter přestupku spáchané příslušníkem Hasičského záchranného sboru Diplomová práce pojednává o fenoménu, který je v právním prostředí Hasičského záchranného sboru (dále jen „HZS“) zcela nový a doposud nepodrobený ucelenému a koncepčnímu právnímu rozboru. Jedná se o právní institut „jednání majícího znaky přestupku, kterého se dopustí příslušník bezpečnostního sboru“. Implementaci předmětného pojmu do právního řádu České republiky přináší zákon č. 361/2003 Sb., o služebním poměru příslušníků bezpečnostních sborů České republiky, v platném znění (dále jen „zákon o služebním poměru“), který je účinný od 1. 1. 2007. Institut jednání majícího znaky přestupku je znám již z předchozí úpravy služebního poměru a v praxi byl uplatňován zejména při řešení deliktů přestupkové míry společenské nebezpečnosti, kterého se dopustili příslušníci Policie ČR. Nová úprava služebního poměru explicitně extrahuje z „obecně-přestupkového“ režimu i příslušníky HZS a stanoví pro ně speciální úpravu zejména procesněprávní povahy odlišnou od procesní úpravy přestupků běžných občanů. Autor práce shledává předmětnou právní úpravu za poněkud nešťastnou a nepřehlednou; pointuje slabá a nejasná místa se snahou o jejich smysluplné řešení, a kde takové řešení není možné a absentuje rovněž možnost řešení cestou výkladovou, tam se autor snaží o možnou úpravu de lege ferenda. Diplomová práce je vedena snahou o koncepční a ucelené zpracování problematiky ukotvené do historického kontextu a fixovaného na genezi současné právní úpravy. Jednání mající znaky přestupku je v úvodu pojmově vymezeno a definováno, zařazeno do systematiky správního trestání, dále jsou vymezeny formální i materiální znaky doplněné o pozitivní i negativní vymezení předmětného jevu. Vzhledem ke skutečnosti, že zákon o služebním poměru přináší pouze torzo zvláštní procesní úpravy doplněné o taxativní výčet případů užití postupu dle zákona č. 200/1990 Sb., o přestupcích, v platném znění, je nutné se při řízení a rozhodování o jednání majícím znaky přestupku obrátit na užití obecné úpravy služebního procesu. Služební funkcionář je odkázán na zákon č. 500/2004 Sb., správní řád, v platném znění (dále jen „správní řád“), který právně kodifikuje správní řízení. Autor práce se domnívá, že právě provázání speciální právní úpravy s úpravou obecnou je pro řízení kruciální a proto rovněž věnuje enormní pozornost zásadám vyplývajícím ze správního řádu, které aplikuje na specifika řízení ve věcech služebního poměru; nezbytnou je pak průběžná komparace s obecně přestupkovou úpravou. Tato část práce je základem rozhodování o jednání majícím znaky přestupku a zároveň hlavním pilířem přemosťujícím většinu problémů plynoucích z polovičaté procesní úpravy. Další rozsáhlejší pasáží je stať popisující úkony služebního funkcionáře před zahájením a zejména při prvoinstančním řízení o jednání majícím znaky přestupku, kterou doplňují i obecné teze o doručování, náhradě nákladů řízení a způsobené škody, jakož i úvaha nad možností aplikace zkrácené formy řízení. Nedílnou součástí řízení je i rozhodování o udělování sankcí, které je plně v diskreční pravomoci služebního funkcionáře. Větší volnost při výběru druhu kázeňského trestu, kterých je typově více, než jakými disponuje obecný přestupkový orgán, klade na služebního funkcionáře v oblasti správního uvážení nestandardní nároky a vyžaduje vysokou odbornost a morální erudici. cionování je úzká vazba na přezkum rozhodnutí, a to zejména formou řádných opravných prostředků. Procesní mechanizmy konstruují rovněž možnost a podmínky užití mimořádných přezkumných mechanizmů s nutnou vazbou na přezkum v rovině správního soudnictví. Finální a nikterak méně důležitým je právní prostor výkonu rozhodnutí, které je pravomocné a vykonatelné, avšak příslušníkem v patřičném termínu nebylo dobrovolně vykonáno. Práci uzavírá popis obecných a společných institutů služebního práva, které upravuje zákon o služebním poměru sice speciálně, leč často poněkud zbytečně duplicitně, což problematiku leckdy komplikuje. V průběhu celého textu je práce doplněna četnými poznámkami pod čarou, které ve snaze o odstranění zbytečné retranspozice již jednou kvalitně zpracované materie odkazují na publikované odborné texty. Veden výše popsanou snahou autor odkazuje rovněž na závěrečné studentské práce publikované přednostně na Právnické fakultě Masarykovy univerzity, což usnadní přístup ke zmíněné materii. Obdobný postup je uplatněn i při provázání textu s judikaturou nejvyšších soudních autorit České republiky. Vzhledem k četné a rozrůstající se judikatuře v rovině obecně-správní a obecně-přestupkové, bylo nutné odkazovat toliko na judikáty zásadní, nebo takové, které pomohou odstranit slepá místa a díry platné právní úpravy. S politováním lze konstatovat absenci judikatury speciálně „služebně-přestupkové“. Práci uzavírají přehledy literatury, judikatury a právních předpisů, které jsou nezbytným doplňkem pro studium institutu „jednání majícího znaky přestupku“.

Abstract:

Act having the nature of an offence committed by a member of the Fire Rescue Service The summarized diploma thesis discusses a phenomenon that is entirely new to the legal environment of the Fire Rescue Service (hereinafter referred to as “FRS”) and has not yet undergone a complete and conceptual legal analysis. The legal institute concerned is called “an act having the elements of an offence committed by a member of the security forces”. The relevant concept was implemented into the body of laws of the Czech Republic by the Act No. 361/2003 Coll. to regulate the service relationship of members of security forces of the Czech Republic, as amended (hereinafter referred to as the “Service Relationship Act”), which has been effective since 1st January 2007. The institute of an act having the elements of an offence was introduced in the preceding regulation of the service relationship, and in practice it was applied especially when settling the offences of administrative infraction gravity, which were committed by members of the Police of the Czech Republic. The new amendment of the service relationship explicitly extracts also the FRS members from the “general-offence” regime, and sets a special regulation for them, procedural in nature, which is different from the procedural regulation for the offences of the next men. The author of the thesis finds the relevant legal regulation rather unfortunate and confused; he stresses the weak and vague points and suggests purposeful solutions thereto, and where no such solution is possible and at the same time no solution by means of an interpretation can be found, the author tries to suggest a possible amendment according to designed law. The leading effort of the diploma thesis is to cover the issue conceptually and comprehensively, anchored in its historical context and fixed to the genesis of the current legal regulation. In the introduction, an act having the elements of an offence is conceptually specified and defined, incorporated in the system of administrative punishing, which is followed by a specification of both formal and material elements thereof as well as the positive and negative determination of the feature in question. With respect to the fact that the Service Relationship Act contains no more than a torso of the special procedural regulation complemented by an exhaustive list of cases of using the procedure under the Act No. 200/1990 Coll., the Offences Act, as amended, it is essential to refer to the use of the general regulation of the service process during the proceedings and decision-making on an act having the elements of an offence. A service official is referred to the Act No. 500/2004 Coll., the Rules of Administrative Procedure, as amended (hereinafter referred to as the “Rules of Administrative Procedure”), which legally codifies the administrative procedure. The author of the thesis assumes that namely the interconnection of the special legal regulation with the general regulation is crucial for the procedure, and therefore he also pays an immense attention to the principles resulting from the Rules of Administrative Procedure, which he applies to the specifics of the proceedings concerning the service relationship; a vital part thereof is a continuous comparison with the general regulation relating to offences. This part of the work constitutes the basis of the decision-making on an act having the elements of an offence, and at the same time the fundamental pillar bridging most problems resulting from the half-hearted procedural regulation. Another sizable passage is a chapter describing the acts of the service official prior to the commencement and especially during the first instance proceedings to deal with the act having the elements of an offence. This part is complemented with general theses on delivery of documents, reimbursement of costs of proceedings and of a damage inflicted, as well as contemplation about the possibility of a

pplying a summary form of proceedings. An inseparable part of the proceedings is also a decision-making on imposing sanctions, which is fully in the discretionary authority of the service official. A larger freedom of choice of the type of disciplinary punishment, which are more varied in kind than those used by the general offence body, makes above-standard demands on the service official in the sphere of administrative discretion, and requires a high degree of proficiency and moral erudition. An inseparable part of both criminal and administrative decision-making and sanctioning is the close connection to the appellate review, namely in the form of regular remedial measures. Procedural mechanisms also construct the possibility and conditions for using extraordinary appellate mechanisms with the necessary connection to a review within the scope of administrative justice. Last but not least, there is the important legal space for the enforcement of judgement that is final and enforceable, but which was not executed voluntarily by the member within the due time-limit. The thesis is concluded with a description of general and common institutes of the service law, which are particularly, but often rather unnecessarily duplicately regulated by the Service Relationship Act, which at times complicates the issue. Throughout the entire text, the thesis is complemented by numerous footnotes, which in the effort to remove the redundant retransposition of the already carefully produced material refer to the published technical texts. Lead by the above described effort, the author refers also to graduate student papers published preferentially at the Faculty of Law, Masaryk University, which shall facilitate access to the aforementioned material. A similar approach was applied also in linking the text with the judgments of the supreme judicial authorities of the Czech Republic. In relation to the extensive and accruing jurisprudence in the general-administrative and general-offence area, it was necessary to refer only to principal judgments, or to those which shall help remove blind points and holes in the legislation in force. Regretfully, it must be noted that there is a lack of special “service-offence” judgements. The thesis is concluded by lists of literature, judgements and legal regulations, which are a necessary complement for studying the institute of an “act having the elements of an offence”.
