The right to the protection of privacy at work from the perspective of employee

Abstract:

Tato bakalářská práce pojednává především o ochraně soukromí zaměstnanců v pracovněprávních vztazích, jak již vypovídá název této práce a dále o možnostech použití právních pramenů ve prospěch zaměstnance pokud zaměstnavatel překročí své pravomoce, ale také ve prospěch zaměstnavatele, aby měl možnost přiměřené kontroly svých zaměstnanců. Práce je rozdělena do několika kapitol a podkapitol. V první kapitole je charakterizováno, co pojem soukromí znamená a koho se konkrétně týká v pracovněprávních vztazích. V další kapitole je nastíněn význam § 316 ZP a poslední, značná část této bakalářské práce je věnována kontrolním mechanismům na pracovišti, kdy má právo zaměstnavatel zaměstnance kontrolovat a kdy nikoliv. Celá bakalářská práce je doplněna významnými judikáty Českých soudů, ale i zahraničních.

Abstract:

This thesis is mainly about the privacy of employees in labor relations, as the name says this work and the possibilities of using legal sources in favor of the employee if the employer overstep their authority, but also the employer to allow him adequate control of their employees. The work is divided into several chapters and subchapters. The first chapter is characterized by what means the concept of privacy and who relates specifically in labor relations. The next chapter outlines the importance of § 316 ZP and last, a considerable part of this thesis is devoted to the control mechanisms in the workplace where the employer has the right to control the employee and when not. The whole thesis is supplemented by important judgments of Czech courts and other foreign.
