Abstract:

V úvodu jsem představila cíl práce – potvrzení či vyvrácení hypotézy, zda je vznik nového institutu správy daní – jednoho inkasního místa, přínosem pro realizaci dobré finanční správy. Podle cílů proklamovaných v souvislosti s daňovou reformou a zejména vznikem JIM by se to mohlo zdát samozřejmé.K hodnocení toho, zda jde o dobrou finanční správu, jsem použila zásady obecně platné v celé oblasti správního práva, které jsou pro oblast veřejné správy obsaženy ve správním řádu. Vycházela jsem z předpokladu, že i když proces správy daní, který je upraven daňovým řádem, není subsidiárně podřízen správnímu řádu, obecně platné principy, zásady a instituty se do něj podstatně promítají a jsou jen v určité míře modifikovány vzhledem ke specifičnosti předmětu daňové správy. Na základě výsledků provedené analýzy by mohlo být zřejmé, že lze pracovní hypotézu potvrdit – JIM je přínosem pro realizaci dobré finanční správy.Domnívám se, že hlavní rizika, která mohou zásadním způsobem negativně ovlivnit výsledky probíhající reformy a vzniku JIM správně vyhodnotila Světová banky ve svém Zhodnocení studie proveditelnosti vzniku JIM. Upozornila na nutnost modernizace daňové správy, zajištění silného politického závazku a konsensu na podporu implementace, což úzce souvisí se zajištěním dostatku rozpočtových zdrojů. Vzhledem k výše uvedenému mám za to, že pokud se podaří tato rizika eliminovat, popř. minimalizovat má JIM všechny předpoklady pro to, aby se stal přínosem pro realizaci dobré finanční správy.

Abstract:

I introduce the goal of the thesis in the introduction – to proof or disproof the hypothesis whether the establishment of a new tax administration institute – the Unified Revenue Collection Agency, is a benefit for implementing the good financial administration. It could seem obvious according to the goals proclaimed in relation to the tax reform and particularly the establishment of JIM. To evaluate whether it is a good financial administration or not, I use the principles generally valid in the whole field of administrative law which are contained in the Rules of Administrative Procedure for public administration. I follow from the prerequisite that although the tax administration process regulated by the Tax Code is not subordinated to the Rules of Administrative Procedure, generally valid principles and institutes are significantly reflected in it and are only modified to a certain extent with regard to the specific subject of tax administration. It could be obvious on the basis of the results of the performed analysis that the working hypothesis can be proven and confirmed – JIM is a benefit for implementing the good financial administration. However, as I mention above, the tax reform and JIM establishment is a very extensive, complex and comprehensive change. It is accompanied by numerous risks which can significantly influence its final impact on whether the new tax administration system will become the good financial administration. I think the main risks which can highly adversely affect results of the ongoing reform and JIM establishment were correctly evaluated by the World Bank in its Evaluation of the Feasibility Study on JIM Establishment. It pointed out the necessity to modernize tax administration, to ensure a strong political commitment and consensus for the support to implementation, which is closely related to the assurance of sufficient budgetary resources. With regard to the aforementioned facts, I believe that if we manage to eliminate or minimize these risks, JIM has all the prerequisites to become a benefit for implementing the good financial administration.
