Legislative Development Tendencies of the Judicial Officer´s Profession

Abstract:

Tato disertační práce se zabývá aktuálním procesem exekuce a postavením soudního exekutora v ČR, přičemž se snaží artikulovat vývojové trendy v této oblasti. Tyto trendy vycházejí nejen z historických souvislostí tohoto řízení, ale též i z inspirujících zahraničních zkušeností zejména v evropských zemích. Předkládaná práce není jen srovnávací prací, založenou na komparativní analýze historického či mezinárodního vývoje této profese, ale je zejména analýzou úpravy de lege lata českého prostředí s významnými instituty, pravidly, zásadami, doktrínami či související judikaturou z pohledu právní úpravy postavení soudního exekutora v ČR. Právnická profese soudního exekutora byla do našeho právního řádu vtělena v září roku 2001 jako přímá reakce na pomalý a opravdu neefektivní postup soudu v rámci výkonu rozhodnutí. Exekučnímu řízení je nutné rozumět jako nucenému procesu výkonu exekučních titulů a zřizování exekutorského zástavního práva, které probíhá pouze prostřednictvím soudního exekutora, tedy fyzické osoby, na kterou stát přenesl část svých soudních pravomocí a která splňuje zákonné předpoklady a stát ji pověřil exekutorským úřadem. Má postavení úřední osoby, která musí být při výkonu exekuční činnosti nezávislá a nestranná. Potvrdil se pracovní předpoklad, že souběžné používání dvou základních pramenů exekučního práva, exekučního řádu a občanského soudního řádu, se již vyčerpalo, zejména z důvodů velkého množství novel, které nesystematicky měnily obě normy, na základě kterých se pomyslné nůžky mezi oběma řízeními stále více a více rozevírají. Je nezbytné plédovat po vzniku nového exekučního kodexu, který upraví komplexně nejen institucionální podmínky vykonávajícího orgánu, ale též komplexně jednotlivé způsoby exekuce. Domněnka, že současná exekuční úprava negarantuje všechny atributy nezávislosti a nestrannosti soudního exekutora, neboť exekuční řád od počátku vzniku obsahuje systémovou chybu, která dává oprávněné osobě právo zvolit si svého soudního exekutora, tím dochází k ekonomické závislosti soudního exekutora na jednom z účastníků exekučního řízení, což fakticky může ohrozit jeho nezávislost a nestrannost, se potvrdila též. Konečně hypotéza o snižování efektivity exekučního řízení byla potvrzena v tom, že k výraznému snížení efektivity vedly masivní novelizace exekučního řádu v posledních více než 10 letech, které jednak přenesly řadu povinností ze soudu na soudního exekutory, zavádějí další procesní povinnosti balastního charakteru, a též soustavně omezují rozsah postižitelného majetku povinné osoby. Na snižování vymahatelnosti práva má též zásadní vliv také nesystémové snižování odměny soudního exekutora, které mimo jiné neumožňuje soudnímu exekutorovi zaměstnávat takový počet zaměstnanců, který by k řádnému chodu exekutorského úřadu tolik potřeboval. Nesystematickou a fragmentární státní regulaci v exekučním právu je nutno ukončit. Je celospolečenský nezbytné zavést moderní exekuční řád, popř. zásadně znovelizovat stávající, který exekuční proces zjednoduší, zruší dvojkolejnost vykonávacího a exekučního řízení a zavede princip, kde jednoho povinného bude exekuovat jen jeden místně příslušný soudní exekutor, kterému bude přidělovat jednotlivé exekuční případy soud, nikoli osoba oprávněná.

Abstract:

The dissertation focuses on the current enforcement procedure and the position of the judicial officer in the Czech Republic, while trying to articulate development trends in this area. These trends are based not only on the historical context of this procedure, but also on inspiring foreign experiences, especially in European countries. The presented work is not only a comparative work, based on a comparative analysis of the historical or international development of this profession, but it is mainly an analysis of the de lege lata adjustment of the Czech environment with important institutes, rules, principles, doctrines or related jurisprudence from the standpoint of the judicial officer in the Czech Republic. The legal profession of judicial officer was incorporated into our legal system in September 2001 as a direct response to the slow and truly inefficient enforcement procedure of the court. Enforcement procedure must be understood as a forced process of enforcement of enforcement titles and the establishment of a judicial officer's pledge, which takes place only through a judicial officer, i.e. a natural person to whom the state has transferred part of its judicial powers and who meets the legal requirements and the state has entrusted it to the judicial officer's office. He has the status of an official who must be independent and impartial when carrying out enforcement activities. The working assumption was confirmed that the simultaneous use of two basic sources of enforcement law - the Code of Enforcement and the Code of Civil Procedure - has already been exhausted, especially due to the large number of amendments that have unsystematically changed both norms, on the basis of which the imaginary scissors between the two proceedings are becoming more and more open. It is necessary to plead for the creation of a new code of enforcement, which will comprehensively regulate not only the institutional conditions of the executing body, but also the individual methods of enforcement. The presumption that the current enforcement regulation does not guarantee all the attributes of independence and impartiality of the judicial officer, since the Code of Enforcement from its beginning contains a systemic error that gives the entitled person the right to choose his judicial officer, thereby resulting in the economic dependence of the judicial officer on one of the participants in the enforcement procedure, which can actually threaten his independence and impartiality, was also confirmed. Finally, the hypothesis of a reduction in the effectiveness of enforcement procedure was confirmed in the fact that massive amendments to the Code of Enforcement in the last more than ten years led to a significant reduction in efficiency, which on the one hand transferred a number of duties from the court to judicial officers, introducing additional procedural obligations of a ballast nature, and also systematically limiting the scope of the enforceable property of the debtor, have led to a significant reduction in efficiency. The non-systematic reduction of the judicial officer's remuneration also has a fundamental influence on the reduction of law enforceability, which, among other things, does not allow the judicial officer to employ such a number of employees as he would need for the proper functioning of the judicial officer's office. Unsystematic and fragmentary state regulation in the enforcement law must be ended. It is socially necessary to introduce a modern code of enforcement, or fundamentally amend the existing one, which will simplify the enforcement procedure, eliminate the double-track nature of enforcement and enforcement procedure and introduce a principle where one debtor will be executed by only one locally competent judicial officer, to whom individual enforcement cases will be assigned by the court, not by the creditor.
