EU Citizens Family Members and Their Status in the Perspective of the Case law of ECtHR, CJEU and the Jurisprudence of Czech courts

Abstract:

Občané EU disponují svobodou pobytu a pohybu fyzických osob v rámci EU, která je jednou ze základních čtyř svobod garantovaných Smlouvou o fungování EU, Smlouvou o EU a také Listinou základních práv a svobod EU. Oni a jejich rodinní příslušníci mají také právo na rodinný a soukromý život. To je upraveno jak v Listině základních práv a svobod EU, tak i v Evropské úmluvě o lidských právech. Zejména ESLP svoji dlouho a četnou rozhodovací praxí v této oblasti nám poskytuje výklad jaké osoby naplňují definici rodiny. Tento výklad je reflektován rovněž Soudním dvorem EU a na základě ustanovení z Listiny základních práv a svobod EU. Ve své rigorózní práci se budu zabývat obsahem Směrnice Evropského parlamentu a Rady 2004/38/ES ze dne 29. dubna 2004 (“pobytová směrnice”) o právu občanů Unie a jejich rodinných příslušníků svobodně se pohybovat a pobývat na území členských států a vysvětlím, co z ní vyplývá. Dále se zaměřím na vnitrostátní úpravu, konkrétně na zákon č. 326/1999 Sb., ve znění pozdějších předpisů, O pobytu cizinců na území ČR (“cizinecký zákon”), který upravuje konkrétní podmínky vstupu na naše území. Porovnám znění těchto dvou předpisů a zhodnotím, zda cizinecký zákon ve znění týkající se rodinných příslušníků občana EU, dostatečně implementuje znění pobytové směrnice. Dále budu zkoumat, zda je judikatura ESLP, v oblasti práva na rodinný a soukromý život, v souladu s judikaturou SDEU, a také zda české soudy ve své rozhodovací praxi, ve spojitosti s udělením práva pobytu pro rodinné příslušníky, rozhodnutí těchto vrcholných evropských soudů reflektují.

Abstract:

EU citizens dispose of the freedom of movement and residence which is one of the four elementary freedoms of EU guaranteed by Treaty on European Union, Treaty on the Functioning of the European Union and Charter of Fundamental Rights and Freedoms of the EU. Citizens of European Union and their family members have the right to have a family life. This is regulated both in the Charter of Fundamental Rights and Freedoms of the EU and in the European Convention on Human Rights. The ECtHR with its long and numerous decision-making practice in this area provides us with an interpretation of which persons fulfill the definition of family. This interpretation is also reflected by the Court of Justice of the EU and based on the provisions of the Charter of Fundamental Rights and Freedoms of the EU. In my rigorous work, I will deal with the content of Directive 2004/38/EC of the European Parliament and of the Council of 29 April 2004 (the "Residence Directive") on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States and explain what follows from it. Next, I will focus on the national legislation, specifically Act No. 326/1999 ("Foreigners Act"), which regulates the specific conditions of entry into our territory. I will compare the wording of these two regulations and evaluate whether the Foreigners Act as it relates to family members of an EU citizen sufficiently implements the wording of the Residence Directive. Furthermore I will examine whether the jurisprudence of the ECtHR, in the area of the right to family and private life, is in accordance with the jurisprudence of the CJEU and also whether the Czech courts in their decision-making practice reflect the decisions of these top European courts.
