Constitutional court as a guarantee of democracy

Abstract:

V Bakalářské práci Ústavní soud jako garant demokracie se budu zabývat zejména tím, zda byl Ústavní soud České republiky od vzniku Československé republiky garantem demokracie. Dále zde nastíním základní fakta o Ústavě České republiky, Ústavním pořádku a Ústavním právu. Budu v ní řešit polohu, historii a význam Ústavního soudu. Ústavní soud České republiky je důležitým soudním orgánem České republiky. Sídlí v Brně a jeho hlavním úkolem je ochrana ústavnosti, zejména ochrana práv a svobod vyplývajících z Ústavy, Listiny základních práv a svobod a dalších Ústavních zákonů České republiky. V úvodní kapitole nastíním, proč jsem si vybrala téma Ústavní soud jako garant demokracie. V další kapitole vymezím cíle, použité metody a základní pojmy. Dále zpracuji kapitoly Základní fakta o Ústavě a Ústavním soudnictví České republiky, Historie Ústavního soudnictví od vzniku Československé republiky do současnosti. Hlavní kapitola bude Ústavní soud jako garant demokracie. Při zpracování bakalářské práce předpokládám použití metody terénního výzkumu – pro získání potřebných údajů, fotografií a dalšího materiálu, který se bude týkat mé bakalářské práce, historickou metodu a srovnávací metodu.

Abstract:

The bachelor thesis Constitutional court as a guarantee of democracy discusses whether the Constitutional Court of the Czech Republic has guaranteed democracy since the creation of Czechoslovakia. It includes basic facts about the Constitution of the Czech Republic, Constitutional regulations and Constitutional law. It also deals with location, history and significancy of the Constitutional court. The Constitutional Court of the Czech Republic is an important juridical institution in the Czech Republic. It resides in Brno and its main task is to protect the constitutionality and the rights and freedom resulting from the Constitution, Charter of Fundamental Rights and Basic Freedoms and other constitutional laws in the Czech Republic. I will explain why I chose Constitutional court as a guarantee of democracy as my thesis in the opening section. Then I'll define the goals, used methods and fundamental terms. Another chapters include Basic facts about the Constitution and the Constitutional judicature in the Czech Republic and History of the Constitutional judicature from the creation of Czechoslovakia until now. The main chapter is called Constitutional court as a guarantee of democracy. I expect using the historical, comparison and field research methods while compiling the bachelor thesis - to get required data, photographs and other material necessary for my bachelor thesis.
