Abstract:

Diplomová práce si klade za cíl posoudit využitelnost institutu svěřenského fondu tak, jak ho zavádí Nový občanský zákoník. První část práce popisuje současnou praxi a nástroje, jimž může být svěřenský fond alternativou. Věnuje se sektoru investičních a penzijních fondů, pojednává o modelech externí správy, daňových rájích. Ve větším detailu rozebírá quebecké trusty, které mohou vzhledem k míře inspirace českých zákonodárců quebeckou legislativou napovědět, jakou podobu nabude sektor svěřenských fondů v České republice. Druhá část práce se věnuje institutu svěřenského fondu a posuzuje jeho atraktivitu v kontextu současné praxe. Rozborem právních předpisů upravujících svěřenské fondy bylo zjištěno, že kromě ryzí správy majetku nelze předpokládat větší rozmach tohoto institutu, neboť stávající daňová legislativa eliminuje výhody, které zřizování svěřenských fondů přináší v zemích, kde je rozšířen.

Abstract:

The thesis aims at assessing the potential of trusts as defined in the New Civic Code of the Czech Republic. The first part of the thesis describes currently exercised practice and tools, which might possibly be replaced by recently codified institute of trust, analyzing investment funds, pension funds, external asset management trends and tax havens. The thesis scrutinizes Quebec trusts, which might be a base to the prediction of the sector of trusts in Czech Republic, given the similarities between relevant parts of Czech and Quebec civil code. Subsequent part is dedicated to the institute of trust as defined by Czech civil code and assesses its attractivity in comparison with current practice. Analysis of relevant provisions suggests that no other purpose than pure asset management would cause the trusts to widely emerge in Czech Republic, as strict Czech tax legislation eliminates advantages trusts typically bear in countries where trusts frequently occur.
