Methodology for investigating robberies

Abstract:

Tato diplomová práce se zabývá metodikou vyšetřování trestného činu loupeže, který patří mezi společensky nejškodlivějších trestných činy současnosti. Práci lze členit na sedm vzájemně propojených částí. První kapitole následující po úvodu je věnována dílem trestněprávní charakteristice trestného činu loupeže a dílem jeho kriminalistické charakteristice. Kapitola druhá popisuje typické stopy a následující kapitola třetí je věnována typickým vyšetřovacím situacím. Stěžejní kapitolou mé diplomové práce je kapitola čtvrtá, v níž jsou popsány zvláštnosti předmětu vyšetřování, zvláštnosti podnětu k vyšetřování, zvláštnosti počátečních úkonů, zvláštnosti vyšetřovacích verzí, plánování a organizace vyšetřování a konečně také zvláštnosti následných úkonů. V kapitole páté je zmíněno zapojení veřejnosti do vyšetřování. Kapitola šestá je věnována zodpovězení nejrůznějších doplňujících otázek, které mne v průběhu vypracovávání mé diplomové práce začaly napadat, za pomoci osob s dlouholetými praktickými zkušenostmi s odhalováním a vyšetřováním násilných trestných činů. V poslední kapitole jsou popsána dvě stěžejní soudní rozhodnutí, která vysvětlují rozdíl mezi trestným činem loupeže a trestným činem krádeže.

Abstract:

This thesis is about the methodology of robbery investigation which belongs amongst the socially most detrimental criminal acts of present times. Thesis can be divided into seven parts. The first chapter that follows the preface is partially about the criminal characteristics of a criminal act of robbery and partially about its investigative characteristics. The second chapter describes typical traces and the following and third chapter is designated to typical investigative situations. The main chapter of my thesis is the fourth chapter where are described specific characteristics of the subject of investigation, specific characterisations of the impulse for investigation, specific characteristics of the initial acts, specific characteristics of investigative versions, planning and organisation of the investigation and lastly also the specific characteristics of the acts to follow. In the fifth chapter is mentioned the involving of the public in the investigation. The sixth chapter is focused on the answering of various additional questions that commenced crossing my mind during the execution of my dissertation with the help of people who have long term experiences with the detecting and investigating of criminal acts. In the last chapter I have tried to explain and describe two core judicial judgements that explain the difference between the criminal act of robbery and criminal act of theft.
