Islam and the legal status of women in society

Abstract:

V úvodu mé diplomové práci se zabývám popisem islámského práva a jeho pramenů, kterým věnuji samostatnou kapitolu. V následující kapitole popisuji ženská práva v islámu, práce následně rozebírá společenskou problematiku právního postavení žen v islámských společnostech a jeho postupný vývoj. Smyslem je představit a porovnat, jakým způsobem se na ženu dívá islám ve své fundamentální podobě a interpretace právního postavení ženy v islámské společnosti. První část práce je zaměřena na předislámské období. Další kapitoly zobrazují problematiku z pohledu Koránu a dalších islámských pramenů a pilířů. Hlavní část práce se zaměřuje na aktuální společensko-právní postavení žen v islámském světě a analyzuje konkrétní problémy. Detailně se potom věnuji problematice náboženských svobod a problematice rovnoprávného postavení žen v islámské společnosti, historickému vývoji a současnému stavu z geografického hlediska. V praktické části mé diplomové práce provádím cílené šetření, jehož účelem je vyhodnocení odpovědí respondentů na soubor otázek a zpracování statistických údajů, které mi poskytly oslovená velvyslanectví. Cílem mé diplomové práce je popsat vývoj práv žen v islámu, možnosti zastoupení žen ve veřejné správě, zhodnocení vnímání islámu muslimskými ženami žijícími v Evropě a muslimskými ženami, které žijí v islámských zemích. Závěrem shrnuji poznatky z teoretické i praktické části a navrhuji možný směr vývoje společnosti.

Abstract:

The beginning of my thesis focuses on the description of Islamic law and its sources, which I have devoted a separate chapter to. In the next chapter, I describe women's rights in Islam, then the work continues on to the social issues of the legal status of women in Islamic societies and its development. The purpose is to introduce and compare how Islam views women in their fundamental form and interpretation of the legal status of women in Islamic society. The first part focuses on the pre-Islamic period. Other chapters show issues from the perspective of the Quran and other Islamic sources and pillars. The main part focuses on the current socio-legal status of women in the Islamic world and analyzes specific problems. I deal in detail with the issue of religious freedom and the issue of equal status of women in the Islamic society, historical development and current status in terms of geography. In the practical part of my thesis I perform targeted surveys designed to evaluate respondents' answers to a set of questions and process the statistical data, which were provided by addressed embassies. The aim of my thesis is to describe the development of women's rights in Islam, the possibility of representation of women in public administration, evaluation of the perception of Islam by Muslim women living in Europe and Muslim women living in Islamic countries. The conclusion summarizes knowledge of the theoretical and practical elements and suggests possible trends and direction of the society.
