Selected legal issues of protection of flat lessor's rights

Abstract:

Tato rigorózní práce se věnuje postavení pronajímatele bytu či domu v rámci trvání nájemního vztahu a rovněž po jeho skončení, a to konkrétně aspektům ochrany jeho zákonem garantovaných práv. Pozornost je věnována nejen právům pronajímatele, ale rovněž jeho povinnostem, které je nutno dodržet k zachování jeho právního postavení a garanci ochrany jeho vlastnického práva. V rigorózní práci je částečně zohledněna i osoba nájemce, jako opačná strana závazkového vztahu, neboť i od jeho postavení v rámci nájemního vztahu se odvíjí postavení pronajímatele. Daná problematika je zkoumána z různých hledisek, jak teoretických, tak praktických.

Abstract:

This thesis is devoted to the lessor of flat or house within the duration of the lease relationship and also after its completion, specifically with regard to the aspects of lessor’s rights guaranteed by law. Attention is paid, not only to the lessor’s rights, but also the obligations, that must be followed to preserve lessor’s legal status and the guarantee of protection of his property rights. The thesis partly deals with the person of tenant, as the opposite party of the contractual relationship, due to his position in rental relationship is based on the lessor’s. These issues are examined from different aspects, both theoretical and practical.
