Abstract:

Diplomová práce se zabývá vztahem mezi odměňováním soudců a konceptem soudcovské nezávislosti, zejména otázkou, do jaké míry je odměňování soudců konceptem soudcovské nezávislosti chráněno před zásahy. Za tímto účelem práce zkoumá jednotlivé složky odměňování soudců, aktéry a způsoby potenciálních zásahů, jakož i modely, jež jsou ve světě užívány pro ochranu odměňování soudců před těmito zásahy. Fungování těchto modelů v praxi je zkoumáno za pomocí analýzy judikatury vybraných soudů a následně konfrontováno s teoretickými přístupy ke konceptu soudcovské nezávislosti.

Abstract:

This thesis focuses on the relationship between judicial remuneration and the concept of judicial independence, specifically on the degree to which the former is protected by the latter from interferences. To do so, the thesis explores the various components that judicial remuneration may consist of, the actors who can interfere with judicial remuneration and the manners in which they may do so, as well as the models established throughout the world in order to protect it. In order to study the actual functioning of these models, the case law of chosen courts is analysed, and the outcome is subsequently confronted with the theoretical approaches to the concept of judicial independence.
