The Conflict of the ECHR and the ECJ Jurisdiction from the Viewpoint of Multi-level Governance
Abstract:
Práce se zaměřuje na střet jurisdikce dvou nejvýznamnějších nadnárodních soudních těles v integrující se Evropě. Průnik působnosti ESLP a ESD se logicky odehrává na poli ochrany lidských práv. Při zkoumání této materie užil autor integračního paradigmatu multilevel governance, které pomáhá vysvětlit mocenské působení obou institucí.
Abstract:
This studies discusses the conflict of the jurisdiction of the European court of human rights and the European court of justice. The decision point of this collision is logically situated in the protection of fundamental human rights. Author used the multilevel-governance paradigm.
