Abstract:

Pro diplomovou práci Prostředky ochrany osobnostních práv jsem se rozhodl z důvodu zájmu o občanské právo a ochranu osobnosti, kdy jsem na podobné téma již vystoupil na studentské vědecké konferenci. Práce obsahuje krátký historický exkurz do ochrany osobnostních práv v Českých zemích i ve světě. Zabývá se účelem ochrany osobnostních práv a vymezuje předmět ochrany osobnostních práv. Zároveň předkládaná diplomová práce zpracovává ochranu osobnostních práv nejen z úhlu pohledu občanského práva, ale i v kontextu práva ústavního a trestního zejména pak trestným činem pomluvy. Diplomová práce rovněž porovnává efektivitu ochrany osobnostních práv podle zákona č. 89/2012, občanského zákoníku, ve znění pozdějších předpisů, a zákona č. 40/1964 Sb., občanského zákoníku, ve znění pozdějších předpisů. V neposlední řadě tato diplomová práce zapracovává úpravu ochrany osobnostních práv ve světle Evropského soudu pro lidská práva a porovnává českou právní úpravu s řeckou, neboť její část byla sepsána v rámci studijního pobytu Erasmus na Aristotelově univerzitě v Soluni. Celá práce pracuje jak s teorií a rovněž zapracovává relevantní judikaturu, kdy se snaží oba prvky se vhodně kombinovat. Snaží se na právo pohlížet jako na homogenní celek a hledat tak můstky mezi jednotlivými právními odvětvími.

Abstract:

As my master thesis topic I chose The means of protecting personal rights. I did it because I am really interested in this issue. One of the reasons why it fascinates me is that we cannot say and we cannot strictly distinguish between protection of personal rights being an institution of private law and public law. In the beginning of my thesis I briefly describe the history of protection of personal rights in our country both in Europe and around the world. In this thesis I wrote about the goal of personal rights. More generally I wrote about crime slander, protection of personal rights based on constitutional law, jurisdiction of European court of human rights, etc. More in depth, I wrote about protection of personal rights in framework of civil code, because this thesis is based on civil law. Especially I compared Act No. 89/2012 Coll., the Civil Code, as amended with Act No. 40/1964 Coll., the Civil Code, as amended. Afterwards, in the comparisons, I claim that the new legislative is a progress and the protection of personal right is stronger than it used to be. To find answer to this question was one of the main tasks of this thesis. Another part of this thesis is based on comparative law. I used my Erasmus programme and I compared protection of personal rights in Czech Republic with the protection of personal rights in Greece. The outcome was that the Czech one is stronger in my opinion. Another essential task of this thesis was finding the line between responsibility in framework of civil law and in framework of criminal law and crime slander. There is no legislative which gives a correct answer in a straightforward way so the answer is necessary to research in jurisdiction. In this thesis I try to synthesise the theoretical knowledge with the jurisdiction and also contrast them. I take protection of personal rights as only one institution and describe it in more views and law disciplines but still think that it is only one institution of law which is called personal rights and it is necessary to work with all of the disciplines together because law is only one and in my opinion it would be wrong to divide it too strictly and understand it too rigidly.
