Temporary Incapacity for Work as a Social Event

Abstract:

Tato diplomová práce je zaměřena na problematiku dočasné pracovní ne-schopnosti jako sociální události v podmínkách České republiky. Cílem prá-ce je podat nejen rozbor tématiky dočasné pracovní neschopnosti a důvodů, proč k tomuto aspektu běžného života většiny z nás dochází, nastínit dů-sledky, které s sebou tato problematika přináší, definovat a blíže vymezit samotný pojem a v neposlední řadě i přinést celkovou analýzu pojmu dočas-ná pracovní neschopnost. Úvodní část práce se bude zabývat stručným roz-borem právních skutečností a definicí pojmu sociální událost. Další část bu-de věnována rozboru sociálních událostí v oblasti sociálního zabezpečení, definování pojmu dočasná pracovní neschopnost, jejím primárním znakům, vzniku dočasné pracovní neschopnosti, průběhu a ukončení, stejně tak i důsledkům a problematice hmotného zabezpečení pojištěnce. Následné kapitoly jsou zaměřeny na řešení kontroly pojištěnců v průběhu trvání dočasné pracovní neschopnosti, na problematiku provádění kontrol ze strany příslušných orgánů a nastínění důsledků porušování režimu dočasné pracovní neschopnosti. Závěr práce se zabývá otázkou současné platné právní úpravy institutu dočasné pracovní neschopnosti, možnými způsoby jejího zneužití a s tím související legislativou.

Abstract:

This thesis focuses on temporary incapacity for work as a social event within the conditions of Czech Republic. The goal of this thesis is to to ana-lyze the issue of the temporary incapacity for work and its causes, to outline consequences, to define and closely specify this legal concept and finally to carry out an overall analysis of the term temporary incapacity for work. The introductory part of the thesis deals with a brief analysis of legal facts and the definition of the term social event. The next part is devoted to the analy-sis of social events in the field of social security and to definition of the concept of temporary incapacity for work, its primary features, the emergen-ce of temporary incapacity for work, the course and termination, as well as the consequences and issues of material security of the insured person. Following chapters are focused on solving the control of insured persons during the temporary incapacity for work, on the issue of making inspections by the competent authorities and outlining the consequences of violating the regime of temporary incapacity for work. The conclusion of the thesis deals with the issue of the current legal regulation of the institute of temporary incapacity for work, possible ways of its abuse and related legislation.
