Land Register Insertion Procedure with the Focus on Procedure Interruption

Abstract:

Předkládaná bakalářská práce se zabývá problematikou řízení o povolení vkladu práva do katastru nemovitostí se zaměřením na důvody přerušení tohoto řízení. V práci jsou též uvedeny prameny právní úpravy, definice pojmů vztahující se k danému tématu a zásady vedení katastru nemovitostí. Před rozborem samotného řízení o povolení vkladu jsou popsány jednotlivé druhy zápisů do katastru nemovitostí (vklad, záznam a poznámka). Největší část této práce je však věnována samotnému řízení o povolení vkladu, přezkumné činnosti a jednotlivým procesním a meritorním rozhodnutím katastrálního úřadu. Samostatnou kapitolou jsou opravné prostředky a podkapitolou příklad z vlastní realitní praxe. Celou prací se prolíná bohatá katastrální judikatura, uvedená v jednotlivých kapitolách, která popisuje řešení jednotlivých situací při vkladovém řízení v rozhodovací praxi soudů. Bakalářská práce je zakončena závěrem s vlastní úvahou de lege ferenda a seznamem použité literatury.

Abstract:

The submitted Bachelor degree work deals with the issue of a proceeding to permit to enter a record of title into the Land Register with the focus on reasons for suspension of such proceeding. In this work there are also mentioned sources of legal regulations, definitions of terms relating to the given topic and principles of administration of the Land Register. Before an analysis of the very proceeding to permit to enter a record, there are described individual types of records into the Land Register (entry, recording, and note). However, the biggest part of this work is devoted to the very proceeding to permit to enter a record, review procedure and individual procedural and meritorious decisions of the Land Register Office. Remedial measures constitute a separate chapter, and an example from own real estate practice constitutes a subchapter. Extensive cadastral case-law - mentioned in individual chapters - penetrates the whole work, and it describes solutions to individual situations in the course of proceedings to enter records in the decision-making practice of courts. The Bachelor degree work is concluded with own consideration de lege ferenda (according to intended law) and with a list of literature used.
