Constitutional Development of Czechoslovakia in the Years 1948 - 1968

Abstract:

Bakalářská práce analyzuje historický a politický vývoj Československa od poválečného období až do konce roku 1968 a jeho dopad na změny právního řádu, zejména v oblasti ústavního práva. První část je věnována období mezi lety 1945 a 1948, kdy došlo k přiklonění k Sovětskému svazu a etablování komunistického režimu. V následující kapitole je popsán únorový mocenský převrat a nastolení diktatury komunistické strany, což mělo za následek odstraňování veškerých rysů právního státu na úkor totalitního režimu. Další kapitoly analyzují cestu od upevňování socialismu a centralizování politické moci přes částečnou liberalizaci společnosti i KSČ až po federalizaci Československa s dopadem na ústavní vývoj. Bakalářská práce je zakončena událostmi roku 1968, kdy byly pokusy o reformy s cílem demokratizace politického systému a právního řádu zmařeny zásahem Sovětského svazu a následnou okupací s cílem „normalizace", jež měla obnovit v Československu sovětskou podobu totalitního režimu komunistické strany.

Abstract:

The Bachelor thesis analyzes the historical and political developments in Czechoslovakia since the post-war period until the end of 1968 and its impact on the changes in the legal system, particularly in the area of constitutional law. The first part is devoted to the period between 1945 and 1948, when Czechoslovakia sided with the Soviet Union and the communist regime established. The following chapter describes the February coup and the establishment of the dictatorship of the Communist Party, which resulted in the removal of all the features of the rule of law at the expense of the totalitarian regime. Other chapters analyze the way from the consolidation of socialism and the centralization of political power through the partial liberalization of the Communist Party and to the federalization of Czechoslovakia with the impact on institutional development. The thesis is concluded by the events of 1968, when there were attempts at reforms to democratization of the political system and the rule of law invalidating the intervention of the Soviet Union and the subsequent occupation of the ' standardization'.
