Reimbursement of Health Care Sought Abroad - New Directive

Abstract:

Tématem diplomové práce je vývoj, obsah a provedení směrnice 2011/24/EU, která požaduje veřejné hrazení zdravotní péče vyhledané v jiném členském státě Evropské unie. Jednotlivé kapitoly diplomové práce se věnují koordinaci veřejného hrazení zdravotní péče v EU, judikatuře ve prospěch volného pohybu pacientů, vývoji projektu směrnice, zásadám směrnice a dílčím opatřením, možnostem implementace směrnice a vlivu na probíhající reformu zdravotnictví v České republice, možnostem implementace v jiných členských státech EU, předpokládaným a odhadovaným přínosem směrnice. Závěr je věnovaný možným omezením volného pohybu pacientů a aplikaci mezinárodního práva soukromého v odpovědnostních vztazích.

Abstract:

The scope of this thesis is the development, content and implementation of the Directive 2011/24/EU, which requires a reimbursement from public funds for health care sought in another EU member state. Individual chapters of the thesis is devoted to the coordination of reimbursement from public funds for health care sought in the EU, to the case law in favor of free movement of patients, development of the project of the Directive, to the principles and sub-measures of the Directive, to the possibilities of implementation and impact of the ongoing health reform in the Czech Republic, to the possibilities of implementation in other Member States EU, and to the expected and estimated benefits of the Directive. The conclusion is devoted to the possible restriction of free movement of patients and application of private international law in case of legal liability.
