Statute of Limitations on Damages

Abstract:

Tato práce se zabývá problematikou promlčení práva na náhradu škody. Pozornost je nejprve věnována obecné právní úpravě promlčení a povinnosti nahradit škodu či jinou nemajetkovou újmu. Dále je analyzována promlčecí lhůta k právu na náhradu škody a vztah §§ 619 a 620 zákona č. 89/2012 Sb., občanského zákoníku. Poměrně podrobně je v práci rozebrána námitka promlčení, zejména je pozornost soustředěna na možnost se námitky promlčení vzdát a na situace, kdy je námitka promlčení shledána v rozporu s dobrými mravy. Následující část práce je pak věnována vybraným specifickým případům promlčení práv na náhradu škody, jde např. o promlčení práva na náhradu škody způsobené nesprávným úředním postupem nebo nezákonným rozhodnutím, práva na náhradu úmyslně způsobené škody, odčinění nemajetkové újmy na zdraví apod. Autorka v práci rovněž poukazuje na problematické a sporné momenty u námitky promlčení a u specifických případů promlčení práva na náhradu škody a nabízí několik úvah de lege ferenda.

Abstract:

This thesis examines the issues of the statute of limitations on damages. Firstly, the attention is drawn to the general legislation of the statute of limitation and the obligation to compensate the material or different non-material loss. The research on limitation period for right to damages and the relation between section 619 and section 620 of the Civil Code is also included. The objection of limitation is analyzed quite in detail, especially with regards to the possibility of waiving the right to object the limitation and the situations, when the objection of limitation is considered being contrary to accepted principles of morality. Subsequently, the research on statutes of limitations on specific chosen cases of rights to damages is included, e. g. the statute of limitations on compensation demanded from the State, which was caused by the incorrect official procedure or unlawful decision, statute of limitations on compensation for the damage committed intentionally or statute of limitations on the damages for personal injury, etc. The author also identifies the problematic and questionable moments related to the objection of limitation and statute of limitations on specific chosen cases of rights to damages, both within the professional public and the judicial practice. The author also suggests some de lege ferenda ideas.
