The comparison of constitutionality of UK and the Republic of Ireland with focus on parliamentarianism

Abstract:

Tato práce se zaměřuje na komparaci ústavnosti Spojeného království Velké Británie a Severního Irska s Irskou republikou se zaměřením na parlamentarismus. Popisuje, v čem všem se Irská republika při tvorbě své ústavy a parlamentu nechala inspirovat svou mateřskou zemí a v čem se naopak odchýlila. Cílem je najít podobnosti a rozdíly mezi britskou parlamentní tradicí a Irskem, jakožto relativně mladým státem. Dále pak podobnosti mezi britskou nepsanou ústavou, která se vyvíjela téměř 800 let a irskou psanou ústavou, která vznikla až v roce 1937. Abych toho dosáhla, rozdělila jsem tuto práci do pomyslných tří bloků, z nichž první popisuje historický vývoj ústavnosti a parlamentu ve Velké Británii- historický vývoj je pro britskou ústavnost a obzvlášť pro britský parlament nesmírně důležitý. Britové si vždy velmi potrpěli na tradici a tak není divu, že na vše, čeho se jim postupem vývoje podařilo dosáhnout, nahlíží jako na svá ?odvěká práva?. Právě toto specifikum britské mentality napomohlo ke kontinuálnímu vývoji parlamentu od 13. století až do dnes. Britský parlament a ústavnost jsou založeny především na historické tradici, jejíž hlavní momenty jsem se snažila v první části své práce popsat. Tato část dále obsahuje i popis politické situace, jež vedla k vytvoření Svobodného irského státu a Irské republiky s důrazem na jejich ústavy. Druhá část práce popisuje samotnou britskou a irskou ústavu, se zaměřením na jejich základní rysy a náležitosti. A britský a irský parlament s jejich specifiky a pravomocemi. Třetí a nejkratší část práce je samotným porovnáním rozdílů a shod nejdůležitějších aspektů ústav a nejzásadnějších rysů parlamentu a legislativního procesu.

Abstract:

This work is about a comparison of United Kingdom of Great Britain and Northern Ireland and the Republic of Ireland with a focus on the parliamentary system. It describes how the Republic of Ireland to create its constitution and parliament was inspired by its mother country and what is different. The goal is to find similarities and differences between the British parliamentary tradition and Irish, as a relatively young state and a similarity between the British 5 unwritten constitution, which has been developed over almost 800 years and written Irish constitution which only came into exist in 1937. The work is divided into three parts. Firstly I describe the historical development of constitutionalism and Parliament in Great Britain. I will demonstrate how the historical development of the British constitution is extremely important for the British Parliament. The British people are use to prefer tradition and appriciate what they achieved in the past, through their age-old law. The development of the British Parliament since the 13th century until today empowered the British mentality and traditions. The main points of this development I have tried to describe in the first part of my work. This part describes also the beginning of the Irish Free State and the Irish Republic and its Constitution. The second part describes the British and Irish constitution, their basic features and requirements. Also the specifics and authorities of the British and Irish parliament. The third and shortest part compares the differences and similarities of the most important aspects of the constitutions and the most fundamental features of parliaments and their legislative processes.
